Book excerpt: In the last few years several States have established specially protected marine areas under their domestic legislation. At the international level the trend towards providing an increased protection to certain marine spaces has also been reflected in a number of treaties and declarations. This volume reviews the recent developments in the field of specially protected marine areas and preservation of the marine environment in general with particular emphasis on a specific region, the Mediterranean Sea. Special attention is devoted to the latter for three reasons. First, the regional framework for the protection of the environment in the Mediterranean (the so-called Barcelona system) has recently been updated and strengthened. Second, the Mediterranean is a typical example of the category of semi-enclosed seas where international cooperation between the bordering States should be particularly encouraged in various fields; this also explains why the scope of this book has been enlarged to also cover fisheries, a field which is closely connected to the sustainable development of marine areas. Last and least, the parochial inclination of the editor also influenced his choice. To complete the picture the relevant texts have been reproduced and a series of maps showing some specially protected marine areas have been drawn.

Confronting theory with evidence, and combining qualitative and quantitative analysis, it compares fourteen case studies of international regimes. It considers what effectiveness in a regime would look like, what factors might contribute to effectiveness, and how to measure the variables. It determines that environmental regimes actually do better than the collective model of the book predicts. The effective regimes examined involve the End of Dumping in the North Sea, Sea Dumping of Low-Level Radioactive Waste, Management of Tuna Fisheries in the Pacific, and the Vienna Convention and Montreal Protocol on Ozone Layer Depletion. Volume 1 deals with the areas within the limits of national jurisdiction, that is, all of the submarine areas extending from the coast to the seaward limit of the continental shelf. As its subtitle indicates, this volume is predominantly concerned with The Continental Shelf. Although the United Nations Convention on the Law of the Sea has still not entered into force, and, indeed, may not do so for many years for some of the major maritime powers, its adoption in 1982 did, nonetheless, usher in a period of relative stability in the rules governing the areas within national jurisdiction, including, in particular, the continental shelf. However, being the creatures of compromise, some of its rules are undeniably vague and it has been left to State practice and international courts and tribunals to develop these rules further, especially those relating to the delimitation of the continental shelf between neighbouring States. Volume 1 provides an analysis of the rules of conventional and custromary law in the light of this practice. Volume 2, on Sea-Bed Mining, deals with the area beyond the limits of national jurisdiction, that is, the submarine area lying seaward of the outer limit of the continental shelf. Volume 3, which will be published at the same time as Volume 2, will provide Documents, Tables and Bibliography relating to the subject matter of the first two volumes.
