One of its authors, Liu Xiaobo, was awarded the Nobel Peace Prize in 2010 but has remained in prison since 2009 for subversive crimes. This collection of essays—the first of its kind in English—examines the trial of Liu Xiaobo, the significance and impact of Charter 08, and the prospects for reform in China. The essays include contributions from legal and political experts from around the world, an account of Liu's trial by his defence lawyers, and a passionate—and ultimately optimistic—account of resistance, repression and political change by the human rights lawyer Teng Biao.

Available in PDF, EPUB and Kindle. Book excerpt: Indonesia has a growing population of almost 300 million people, it is increasingly involved in world affairs, and has a booming economy. The need to better understand its unique, complex, and often obscure legal system, has become pressing. This is true across a wide range of sectors including, but not limited to, trade and investment, crime and terrorism, and human rights. Indonesia's democratization after the fall of Soeharto in 1998 triggered massive social and political changes that opened up this diverse, and formerly tightly-controlled, society. Law reform was a key driver of Indonesia's transformation and its full effect remains to be seen. This book offers clear and detailed explanations of the foundations of Indonesia's legal system in the context of its legal reform and rapid development. It offers succinct commentaries on a wide range of issues, examining the judicial process, the constitution, corruption and the court system, contract law, administrative law, foreign investment, taxation, Islamic law, and family law. It examines current substantive law and judicial interpretation and presents case studies of how the system operates in practice. Written in an accessible and engaging style, this book is an essential guide for readers seeking quick and clear answers to questions regarding the law and its application in Indonesia.

Download or read book Comparative Law Yearbook of International Business written by Dennis Campbell and published by Kluwer Law International B.V.. This book was released on 2005-01-01 with total page 690 pages. Available in PDF, EPUB and Kindle. Book excerpt: The 2004 volume of the Comparative Law Yearbook of International Business contains a wide variety of topics of interest to international commercial lawyers and their clients. Various areas of company law are discussed, including mergers and acquisitions, piercing the corporate veil and the financing of share acquisitions. The Yearbook also contains several chapters on investments and securities, including the need for corporate governance in this area and the role of collective investment schemes in Bermuda. Some chapters deal with the introduction of now technology into the competition law issues encountered by the telecommunications industry. The introduction and effects of new legislation generally are also addressed, including the new Ukrainian Commercial Code and Brazilian Civil Code. In addition to discussions on intellectual property, arbitration and asset protection, the Yearbook contains a section on real property rights, including a very interesting comparison between the way in which China and Indonesia view property rights and the treatment received by such rights in Western society. Various areas of law also are looked at from a European point of view, such as the increase in American-style asbestos litigation in Europe, the hiring out of workers within Europe and the effect of the European Convention on Human Rights upon business. With the ever-increasing introduction of new technology, the expansion of global communications, new attitudes towards business and commerce and increased awareness of personal and property rights, there is a constant need for the law to develop in order to adequately deal with these issues. The yearbook branches out into some of the innovative and topical areas of contemporary law, and should be of great interest to anyone involved in modern-day business.

Book Asian Legal Revivals

Download or read book Asian Legal Revivals written by Yves Dezalay and published by University of Chicago Press. This book was released on 2010-11-15 with total page 304 pages. Available in PDF, EPUB and Kindle. Book excerpt: More than a decade ago, before globalization became a buzzword, Yves Dezalay and Bryant G. Garth established themselves as leading analysts of how that process has shaped the legal profession. Drawing upon the insights of Pierre Bourdieu, Asian Legal Revivals explores the increasing importance of the positions of the law and lawyers in South and Southeast Asia. Dezalay and Garth argue that the current situation in many Asian countries can only be fully understood by looking to their differing colonial experiences—and in considering how those experiences have laid the foundation for those societies’ legal profession today. Deftly tracing the transformation of the relationship between law and state into different colonial settings, the authors show how nationalist legal elites in countries such as India, Indonesia, Malaysia, the Philippines, Singapore, and South Korea came to wield political power as agents in the move toward national independence. Including fieldwork from over 350 interviews, Asian Legal Revivals illuminates the more recent past and present of these legally changing nations and explains the profession’s recent revival of influence, as spurred on by American geopolitical and legal interests.

Book Thailand History Politics and the Rule of Law

Download or read book Thailand History Politics and the Rule of Law written by James Wise and published by Marshall Cavendish International Asia Pte Ltd. This book was released on 2019-04-15 with total page 375 pages. Available in PDF, EPUB and Kindle. Book excerpt: This introductory book on Thai politics and the rule of law explains why chronically unstable Thailand struggles to mediate and adjudicate its political disputes. It focuses on the continuities between the pre-1932 and post-1932 periods. Since the shift to constitutional monarchy in 1932, the power of the monarch and military has endured, the legislature, electorate and, until recently, judiciary have been comparatively powerless, and constitutions and laws have been comparatively unimportant. Historical continuities are also evident in the persistence of hierarchical thinking and ethno-nationalism, both of which have inhibited open debates about governance. And the rule of law does not always apply, owing to different principles underlying western and traditional Siamese law and the emergence of a distinctively Thai legal culture and consciousness. Thailand’s governance was re-cast ambitiously in the 1890s, 1932 and 1997. Since 1997, governing Thailand and developing Thailand’s economy have become harder. So political disputes have become more acute and the absence of a national consensus on dispute settlement mechanisms more obvious. Until governance is again re-cast, Thailand’s political instability and cycle of coups will continue.

Book Law and Labour Market Regulation in East Asia

Download or read book Law and Labour Market Regulation in East Asia written by Sean Cooney and published by Routledge. This book was released on 2003-08-29 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: This edited collection examines the labour laws of seven industrializing East Asian societies - China, Indonesia, Malaysia, South Korea, Taiwan, the Philippines and Vietnam - and discusses the variation in their impact across the whole region. Leading scholars from each country consider both laws pertaining to working conditions and industrial relations, and those that regulate the labour market as a whole. Legislation concerning migrant labour, gender equality, employment creation and skills formation is also examined. Adopting their own distinct theoretical perspectives, the authors trace the historical development of labour regulation and reveal that most countries in the region now have quite extensive frameworks. This book will be particularly useful to people interested in the place of labour law, and law in general, in contemporary East Asian societies.
