Book excerpt: This title was first published in 2000: The book analyses the development of arctic environmental cooperation since the late 1980s until the establishment of the Arctic Council in 1996. The study is based on the discourse analysis of statement, documents and interviews by the different actors in the cooperation. In this book, the problem of the environment is seen as a problem of order: it is a problem of ordering relations among related actors, of ordering priorities of action and of ordering relations between different institutional arrangements locally, regionally and internally. Three discourses were found in the cooperation: discourses of sovereignty, knowledge and development. In the discourse of sovereignty, the development of relations between state and indigenous peoples in terms of international environmental cooperation is central. In the discourse of knowledge, the different forms of knowledge and the role of different producers of knowledge in cooperation has been discussed. The discourse of development focuses on the idea of sustainable development and its applications in defining the future of the Circumpolar North and the activities of the Arctic Council. The arctic cooperation can be understood as a regional effort to make an order of sustainability into practice.

With its varied populations, and with eight Nations asserting territorial interests, the Arctic needs a careful approach to its protection and development. This report describes the current Arctic environmental legal regime. It also discusses the possibility of negotiating a sustainability treaty for the Arctic with high standards of environmental protection similar to those in the 1991 Protocol on Environmental Protection to the Antarctic Treaty. It is hoped that this review of the legal and policy contrasts between the Arctic and Antarctic can help in the consideration of future directions for the Arctic legal regime.

In this book – diverse perspectives on environmental security in the Arctic Ocean are shared in chapters from high-level diplomats, parliamentarians and government officials of Arctic and non-Arctic states; leaders of Arctic indigenous peoples organizations; international law advisors from Arctic states as well as the United Nations; directors of inter-governmental organizations and non-governmental organizations; managers of multi-national corporations; political scientists, historians and economists; along with Earth system scientists and oceanographers. Building on the “common arctic issues” of “sustainable development and environmental protection” established by the Arctic Council – environmental security offers an holistic approach to assess opportunities and risks as well as develop infrastructure responses with law of the sea as the key “international legal framework” to “promote the peaceful uses” of the Arctic Ocean. Book excerpt: Arctic-wide intergovernmental cooperation protecting the Arctic environment formally began with the establishment of the Arctic Environmental Protection Strategy (AEPS), which later transformed into the Arctic Council. However, the founding documents of cooperation in both were soft-law in nature rather than internationally concluded treaties. The main objective of the Arctic Council is to promote 'environmental protection' and 'sustainable development' in the Arctic. Neither the AEPS nor the Arctic Council included the issue of climate change in their working agenda or as a primary concern during their establishment. However, the AEPS was concerned with the 'global climate' during its formation, although it decided not to address the issue since other international forums had already started to work on it. Nevertheless, climate change seriously affects both of the main objectives of the Council: environmental protection and sustainable development in the Arctic. In the course of time, climate change has become an important issue within Arctic-wide cooperation. The Council provides significant information to policy-makers and other actors by conducting a number of projects to limit climate change in the Arctic or address the consequences caused by climate change to its ecosystems and inhabitants. Even with its institutional weaknesses due to the lack of proper mechanisms, the Council functions through its various working groups and their programs. Two decades after the beginning of cooperation, it is timely to conduct an extensive evaluation of its success mainly in the field of climate change.

Young divides the overall process of regime formation into three stages—agenda formation, negotiation, and operationalization—and argues that each stage has its own particular political dynamics. Empirically, Young examines in detail the events leading to the formation of the Arctic Environmental Protection Strategy and the Barents Euro-Arctic Region.
