Book excerpt: Excerpt from The Alaska Boundary It looks very long, but I wished to sustain every statement by an appeal to charts, maps, official documents, special papers, pro and con, and whatever would add authority to the investigation. I have named the authorities, and in critical points have used the original French text of the letters and documents that passed between the Plenipotentiaries of Russia and Great Britain, pre ceding the date Of the Convention of 1825; and which, in part, were used in the Fur Seal Arbitration of 1892. As I believe great weight will be given to a strict construction of the French texts of the Convention of 1825, and the Treaty of 1867, I have introduced each document with the French and English texts in parallel columns; and have freely criticised the weak and unequivalent English translation. I understand that the French draft only was Signed; certainly French was the diplomatic langt ge Of the earlier period. I have given some space to the inside or secret history Of the Negotiations of 1825. The boundary incident Of the Convention was confessedly a struggle between the two great fur companies, Russian and British. Book excerpt: Excerpt from Alaska Boundary: Memorandum for Counsel; Various Documents Bearing on the Question of the Alaska Boundary In compliance with a resolution of the House of Representatives of the 16th of February last, requesting the President of the United States "to communicate to that House whether any foreign Government has made claim to any part of the territory of the United States upon the coast of the Pacific ocean north of the forty-second degree of latitude, and to what extent; whether any regulations have been made by foreign Powers affecting the trade on that coast, and how far it affects the interests of this republic; and whether any communications have been made to this Government by foreign Powers touching the contemplated occupation of Columbia river," I now transmit a report from the Secretary of State, containing the information embraced by that resolution. The Secretary of State, to whom has been referred the resolution of the House of Representatives of the 16th of February last, requesting the President of the United States "to communicate to that House whether any foreign Government has made claim to any part of the territory of the United States upon the coast of the Pacific ocean north of the forty-second degree of latitude, and to what extent; whether any regulations have been made by foreign Powers affecting the trade on that coast, and how far it affects the interests of this republic; and whether any communications have been made to this Government by foreign Powers touching the contemplated occupation of Columbia river," has the honor of submitting to the President sundry papers, containing the information embraced by the resolution. At the time when the subject of the proposed occupation of the Columbia river was presented to the consideration of Congress, at their last session, the minister of Great Britain, at two several interviews with the Secretary of State, suggested that Great Britain had claims on the northwest coast of America, with which he conceived that such occupation on the part of the United States would conflict; and requested to be informed what were the intentions of the Government of the United States in this respect. The Secretary of State declined answering those inquiries, or discussing those claims, otherwise than in writing. But no written communication upon the subject has been received. I have seen it stated in the public prints here, at one time, that it concerned the acquisition by England of a vast gold-bearing territory; and at another, that it affected the possession of that archi pelago which borders the western coast of British Columbia. As a matter of fact, so far as I am aware, no gold or other mineral deposits of any special value have so far been discovered within the disputed territory, which is merely a narrow strip bordering the coast line. It is in Alaska proper and the great Yukon district and north-west Territory, which two latter indisputably belong to Canada, that the important gold-fields lie. While as to the archi pelago, though at one time Canada, I find, did put forward a claim that the coast line should be taken to the outer rim of these islands, according to the Colonial Office here that claim has been definitely abandoned, and no question remains but that the islands are all in United States territory. Each government disclosed a purpose to assert in behalf of its citizens the right of trade on the northwest coast, and denied the sovereignty of Russia over those regions. Negotiations were begun between Russia and the United States on the one hand and Russia and Great Britain on the other hand in 1822, looking to an adjustment of these ques tions. In these negotiations both Great Britain and the United States asserted title to portions of the northwest coast which had been brought into controversy. Inasmuch as the same questions were involved, at the suggestion of the Russian government, the negotiations, both in behalf of Great Britain and of the United States, were carried on at St. Petersburg. It was even suggested that the interests and claims of the three powers be adjusted by a joint convention. On that map the line is continued from where it is sup posed to meet the continent, and passes along the coast to Juneau, to, as outlined in No. 2; but does not comply with the requirements of the Treaty by remaining ten (10) laurine leagues from the ocean coast. Besides, not being in accordance with the wording of the Treaty, much of the line. Of demarcation north of latitude 56' is through an impracticable country abounding in glaciers, precipices and deep 1a1111es, entirely unsuited for an international boundary line. Book excerpt: Excerpt from Proceedings of the Alaskan Boundary Tribunal, 1904, Vol. 4 The United States, pursuant to the provisions of Article II of the treaty of January 24, 1903, herewith submits to the Tribunal created thereunder, its printed Counter Case and additional documents, correspondence and evidence, in reply to the printed Case, documents, correspondence and evidence presented to the Tribunal on behalf of Great Britain. The United States, considering that the scope of the printed Cases was to set forth the positions of the respective governments as to the matters in controversy without reference to the attitude heretofore taken by the other, did not in its printed Case anticipate the claim which it was presumed would be advanced by the British Government, or adduce evidence to controvert the same. Furthermore, had such a course, in the opinion of the United States, been in accord with the intent of the treaty of January 24, 1903, that government would have been embarrassed in pursuing it by reason of the varied and conflicting claims, which have been from time to time in recent years advanced by public men and writers in Canada, as to the delineation of the boundary line now under consideration. As a further reason for avoidance of such a course by the United States, the Government of Great Britain had never officially indicated which, if any, of the several lines heretofore proposed by Canadian statesmen, writers and cartographers would receive its official approval and support. Under these circumstances the United States deems that it would have been inappropriate on its part to have followed a method of treatment based solely upon conjecture as to the attitude which would be assumed by His Majesty's Government. Moreover, since the attitude of Great Britain was uncertain, the concessions which might be made on her part were equally so.
