This study offers the first exploration of the service records of 450 of these wayward Confederates, most often deserters. Arranged by army, corps, division and brigade, it chronicles their military trials and frequent executions and offers explanations of how the lucky and the clever were able to avoid their fate. Focus on court activity by company allows for comparisons that emphasize the wide disparity in discipline within a regiment and brigade. By stressing the effectiveness of these deadly decisions as deterrents to others, this work maintains that an earlier and wider reliance on execution would have strengthened the Confederacy sufficiently to force a negotiated end to the war, thus saving many Confederate and Federal lives.

Book excerpt: A short but colorful memoir by a sergeant in the 2nd Texas regiment, which served with distinction in the Western Theatre of the Civil War. Sergeant Smith volunteered in the first months of the outbreak of the Civil War, but his first real taste of the conflict came as part of the Army of the Mississippi under General Albert Sidney Johnson at Shiloh. The author recounts the confused nature of the fighting around the Hornet’s Nest and the sorrow of the repulse but above all the deep sense of loss at the death of their Confederate leader. After duties around the outskirts of Vicksburg, Smith and his comrades were among the Confederate soldiers that were penned up there by the Union forces under General Grant. Despite a fierce resistance the Confederate soldiers of Vicksburg were forced to surrender and the troops were paroled. It explains how the "outliers" (deserters and draft-dodgers) managed to elude capture and survive despite extensive efforts by Confederate authorities to hunt them down and return them to the army. The author discusses the development of the secret underground pro-Union organization the Heroes of America, and how its members utilized the Underground Railroad, dug-out caves, and an elaborate system of secret signals and communications to elude the "hunters." Numerous instances of murder, rape, torture and other brutal acts and many skirmishes between gangs of deserters and Confederate and state troops are recounted. In a revisionist interpretation of the Tar Heel wartime peace movement, the author argues that William Holden's peace crusade was in fact a Copperhead insurgency in which peace agitators strove for a return of North Carolina and the South to the Union on the Copperhead basis--that is, with the institution of slavery protected by the Constitution in the returning states.
