Book excerpt: In 1976, under section 4(e) of the Toxic Substances Control Act (TSCA), the U.S. Congress created the TSCA Interagency Testing Committee (ITC) to decide which chemicals should be recommended to the Administrator of the U.S. Environmental Protection Agency for testing. In 1988, under the Canadian Environmental Protection Act (CEPA), the Government of Canada created the Domestic Substances List and Priority Substances List. This paper briefly describes the ITC, the different ITC testing decisions and a few of the ITC's 11,150 testing decisions for the 21,413 chemicals on the CEPA Domestic Substances List and some of the 24 testing decisions for the 44 chemicals and chemical groups on the CEPA Priority Substances List. The paper describes the approaches and rationales that the ITC used to make testing decisions for these chemicals on the CEPA Domestic Substances List or the CEPA Priority Substances List so that Canadians and others who need to prioritize chemicals for testing or risk reduction may apply or modify the principles used by the ITC. Also described, for the first time, for chemicals on the CEPA Domestic Substances List or the CEPA Priority Substances List, are some of the chemical fate and aquatic toxicity data that were developed during and as a result of ITC's decisions, e.g., the aquatic toxicity and chemical fate data for di-tert-butylphenol, ethyl benzene, brominated flame retardants, phthalate esters, chloroparaffins, chlorinated benzenes and anilines.

Book excerpt: The Interagency Testing Committee (ITC) was created by the U.S. Congress in 1976 under Section 4(e) of the Toxic Substances Control Act (TSCA) as an independent advisory committee to the Administrator of the U.S. Environmental Protection Agency (EPA). The ITC is responsible for establishing the TSCA Section 4(e) Priority Testing List, revising the Priority Testing List at least every 6 months, identifying and coordinating the Federal Government's data needs for chemicals and chemical groups on the Priority Testing List, and designating the highest priority chemicals and chemical groups on the Priority Testing List to the EPA Administrator for testing under TSCA Section 4(a). Under TSCA, the EPA Administrator must publish ITC Reports containing revisions to the Priority Testing List in the Federal Register, take actions on the ITC's designated chemicals and chemical groups and publish those actions in the Federal Register.

Book excerpt: Pursuant to a congressional request, GAO evaluated the Interagency Testing Committee's (ITC) and Environmental Protection Agency's (EPA) implementation of the chemical testing program under the Toxic Substances Control Act (TSCA). GAO found that: (1) EPA and ITC had identified for testing less than 1 percent of the more than 60,000 chemicals in the TSCA inventory; (2) neither ITC nor EPA had produced a list of chemicals that did not require testing; (3) since the enactment of TSCA, EPA had completed test data for only six chemicals and had not finished assessing those; (4) ITC members' poor attendance may have contributed to its lack of crucial data it needed to make recommendations; (5) after proposing test rules, EPA continued to take an average of more than 2 years to make them final; and (6) the EPA and ITC testing program lacked overall objectives and a strategy for achieving them.

Book excerpt: Most of the chemicals tested under TSCA are nominated by the Interagency Testing Committee (ITC), which was established by TSCA to recommend semiannually to EPA chemicals that should receive priority consideration for testing. Within EPA, the Office of Toxic Substances receives testing nominations from other organizations, such as other federal agencies, and has instituted testing programs in response to these nominations. However, for ITC nominations alone, EPA is required under TSCA to respond to the nomination within 1 year by initiating rule making to require testing by industry or to explain its reasons for not doing so in the Federal Register. All of the chemicals discussed in this fact sheet were nominated by ITC. Chemical testing rulemaking is initiated when EPA develops and publishes in the Federal Register a proposed test rule. Industry sometimes initiates a testing program voluntarily after issuance of the proposed test rule. If EPA determines that industry's voluntary testing program is adequate, EPA may announce a 'decision not to test' in the Federal Register. If industry does not conduct voluntary testing, EPA may issue a 'consent order, ' under which industry agrees to test a chemical according to a set plan and time frame. jg p.2.
