In addition, however, they have appeared in a number of marine fisheries in traditional communities and are also being acquired, legally or extra-legally, for such techniques as floating fish aggregation devices and other forms of fixed gear. TURFs provide interesting opportunities for dealing with two major aspects of fisheries management -efficient production of net benefits and equitable distribution of benefits. Further exploration of the possible adoption of TURFs as a means for management seem desirable. This paper explores some of the definitional elements of TURFs and the distinctions between territorial rights and common property. It also exercises some of the conditions that may have an effect on the creation and maintenance of TURFs. And it discusses briefly some of the implications for equitable distribution of benefits.

Ragnar Amason suggested to Phil Neher a small, mid-Atlantic conference on recent developments in fishery management. In the event, more than twenty papers were scheduled and over one hundred and fifty conferees were registered. Logistical complications were sorted through for a summer 1988 conference in Iceland. The really innovative management programs were in the South Pacific; Aus tralia and New Zealand had introduced Individual Transferable Quotas (ITQs); and Iceland, Norway and Canada were also experimenting with quotas. It seemed to the program committee (Rognvaldur Hannesson and Geoffrey Waugh were soon on board) that these quotas had more or less characteristics of property rights. Property rights were also taking other forms in other places (time and area licenses, restrictive licensing of vessels and gear, traditional use rights). The idea of rights based fishing became the theme of the conference.

National governments have recognized that the absence of such rights coupled with the technological advances in commerical fishing have resulted in widespread economic and environmental problems (e.g., overfishing, bycatching, highgrading, increased physical dangers, and lower profits). The most significant solution to these problems, and the predominate concern of this book, is the institution of Individual Transferable Quotas (ITQs), also known as Individual Fishing Quotas (IFQs). These are national and global policies, public- and private-sector managed allocations of the amount of various species of fish, at certain qualities can be harvested at particular times by fishers.

Book excerpt: Small-scale fisheries support millions of people around the world but they face a common issue of overcapacity and, subsequently, an overexploitation of resources. One solution to this is through the implementation of territorial-use rights in fisheries (TURFs) where specific areas are designated for fishing by specific individuals or groups while excluding all others. In El Corredor, Baja California Sur, small-scale fishers target a variety of reef fishes under a permit system managed by cooperatives using hook-and-line, of which the Pacific red snapper (Lutjanus peru) is the most important species economically and socially. After concerns arose about possible overexploitation of fishery resources, in part due to competition with industrial fishers, fishers in El Corredor became interested in establishing TURFs over their fishing grounds. Using a spatial bioeconomic model called TURFtools, we explored the possible impacts of establishing TURFs in El Corredor to provide fishers with the knowledge necessary to make informed management decisions for their fisheries. Of the five scenarios tested, we found combining TURFs with no-take reserves—whether maintained at their current size or expanded—had the highest increase in fish abundance, fisher harvest, and fisher profit in comparison to the status quo after 20 years. TURFs may be beneficial to El Corredor fishers in addressing overcapacity issues within their fisheries given they can collaborate on how best to manage these TURFs. Though the use of TURFs to manage small-scale finfish fisheries needs to be further explored, this study is the first step in exploring their efficacy.
