Book excerpt: Esta obra objetiva estudar a Teoria da Distribuição Dinâmica do Ônus da Prova inserida no novo Código de Processo Civil, através dos parágrafos primeiro e segundo do art. 373. Em sede de evolução histórica, o Código de Processo Civil de 1973 consagrou a teoria estática do ônus da prova, prevendo critérios predefinidos para cada uma das partes do processo se desincumbir do seu ônus probatório. Essa teoria, no entanto, mostrou-se insuficiente para resolver os casos concretos, ante a complexidade das relações sociais. O critério fixo baseava-se na distribuição do ônus da prova conforme a posição das partes no processo, ou seja, ao autor competia provar o seu direito, enquanto ao réu, fato impeditivo, extintivo ou modificativo do direito do autor. Não se preocupava em analisar a maior dificuldade ou a maior facilidade das partes em levar a prova aos autos. Essa sistemática por vezes gerava injustiça no caso concreto, pois impingia a uma das partes uma prova diabólica. A jurisprudência, atenta às evoluções sociais, começou a reconhecer formas diversas de distribuição do ônus da prova e os juristas responsáveis pela elaboração do novo Código de Processo Civil incluíram no projeto a Teoria da Distribuição Dinâmica do Ônus da Prova, tal como será analisado neste livro.

A cooperação, positivada como norma fundamental, reflete em diversas fases do processo, e almeja que todos aqueles que participem da relação processual, cooperem entre si, a fim de se alcançar uma decisão de mérito justa e efetiva e em tempo razoável. No deslinde do processo, muitas questões podem ser solucionadas com uma postura ativa do juiz e das partes, dessa forma, concretizando o princípio da cooperação. O Novo Código de Processo Civil, previu a possibilidade de distribuição dinâmica do ônus da prova, em situações excepcionais e atendidas algumas peculiaridades do caso concreto. Dessa forma, aquele que inicialmente não tinha o encargo probatório, poderá ter invertido em seu favor tal ônus. Nessa perspectiva de processo cooperativo, à parte que detenha melhores condições probatórias deverá ser encarregada de produzir a prova, sob pena de sofrer uma decisão desfavorável. Quando o juiz distribui dinamicamente o ônus probatório, consegue viabilizar a concretude de outros direitos fundamentais, como o devido processo legal, o acesso à Justiça e o direito fundamental à prova, além de também consolidar a tão almejada cooperação processual.

Como os estudiosos de processo sabem, a técnica da dinamização do ônus da prova poderá ser empregada sempre que houver desequilíbrio entre as partes litigantes em matéria probatória, relacionado à impossibilidade ou à excessiva dificuldade de uma das partes na produção da prova por quem detém o ônus ou, ainda, à maior facilidade na prova do fato contrário por quem não possui o ônus. Pela referida teoria, que se fundamenta nos princípios da isonomia e cooperação entre os sujeitos processuais, não é aceitável o estabelecimento abstrato e prévio do ônus da prova, bem como é indiferente a posição assumida pela parte na demanda e a natureza dos fatos discutidos. Nesta obra, são avaliados a aplicabilidade da distribuição do ônus da prova no processo do trabalho, tanto antes quanto depois da Reforma Trabalhista (Lei no 13.4067/2017), os requisitos para aplicação supletiva e subsidiária das normas do CPC/2015 ao processo laboral, a aplicabilidade da regra in dubio pro operario em matéria de prova e a possibilidade da distribuição dinâmica por convenção entre as partes.

Over the course of our investigation, we collected extensive evidence from these companies aswell as from third parties - totaling nearly 1.3 million documents . We held seven hearings to review the effects of market power online including on the free and diverse press, innovation, and privacy and a final hearing to examine potential solutions to concerns identified during the investigation and to inform this Report's recommendations .
