Book excerpt: "This is an important collection and starting point for the worthy goal of promoting a better understanding of the past that makes it less able to be manipulated for contemporary political and religious aims...Compiled out of the European past, its aim of a better understanding of traditional values ought to be useful for contemporary cultures and for the work of scholars of all cultures and continents." - Renaissance Quarterly In the last decade or so, many books have been devoted to the history of Europe. Two conceptual axes predominate in a large number of these accounts: a discourse focusing on Europe's values, and another discourse, fashioned largely in opposition to the first, which emphasizes the process of European "construction." The first conceives of Europe's past teleologically, as a process by which certain values (Christian ethics, individualism, capitalism, tolerance, republicanism, due process, etc.) were affirmed and came to define European culture. The second approach rejects the discourse on values emphasizes the post-Enlightenment emergence of the concept of Europe, and the political and ideological implications in its continuous redefinitions (and re elaborations) during the past two or more centuries. This volume offers new approaches that integrate the long temporal dimension of the values-based approach, albeit devoid of its teleological element, with the "constructivist" interpretation.

Book Traditions and Change in European Administrative Law

Download or read book Traditions and Change in European Administrative Law written by Roberto Caranta and published by Apollo Books. This book was released on 2011 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: The background to this collection of paper is formed by the changes in contremporary society. In modern-day western societies it is the thought that individualism trumps collectivisim. There is change from the paradigm of hierarchy to a paradigm of cooperation. This effects administrative law, which is traditionallly top-down, but is slowly accepting and incorporating mechanism of negotiation and bottom up involvement of stakeholders and concerned individuals. The contributors to his volume investigate, these changes in administrative law and provide an assessment as to whether and to what extent they are reflected in the way judicial review of governmental action is shaped. The analysis covers the EU and a number of EU jurisdictions (France, Germany, United Kingdom, the Netherland, Italy and Romania.) representing different administrative law traditions and being differently responsive to change. To provide an outside comparision, the US administrative system is also covered. Book jacket.

Book Criminal Proceedings Languages and the European Union

Download or read book Criminal Proceedings Languages and the European Union written by Francesca Ruggieri and published by Springer Science & Business Media. This book was released on 2013-08-28 with total page 237 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book “Criminal proceedings, languages and the European Union: linguistic and legal issues” – the first attempt on this subject – deals with the current situation in the jurislinguistic studies, which cover comparative law, language and translation, towards the aim of the circulation of equivalent legal concepts in systems which are still very different from one another. In the absence of common cultures and languages, in criminal procedure it is possible to distinguish features that are typical of common law systems and features that are typical of civil law systems, according to the two different models of adversarial and inquisitorial trials. Therefore, the most problematic challenges are for the European Union legislator to define generic measures that can be easily implemented at the national level, and for the individual Member States to choose corresponding domestic measures that can best implement these broad definitions, so as to pursue objectives set at the European level. In this scenario, the book assesses the new framework within which criminal lawyers and practitioners need to operate under the Lisbon Treaty (Part I), and focuses on the different versions of its provisions concerning cooperation in criminal matters, which will need to be implemented at the national level (Part III). The book analyses the issues raised by multilingualism in the EU decision-making process and subsequent interpretation of legal acts from the viewpoint of all the players involved (EU officials, civil, penal and linguistic lawyers: Part II), explores the possible impact of the EU legal acts concerning environmental protection, where the study of ascending and descending circulation of polysemantic words is especially relevant (Part IV), and investigates the new legal and linguistic concepts in the field of data retention, protection of victims, European investigation orders and coercive measures (Part V).

Book Dalla struttura alla funzione

Download or read book Dalla struttura alla funzione written by Norberto Bobbio and published by Gius.Laterza & Figli Spa. This book was released on 2014-06-13T00:00:00+02:00 with total page 191 pages. Available in PDF, EPUB and Kindle.

Download or read book Globalization and Human Rights written by Jesús Ballesteros and published by Springer Science & Business Media. This book was released on 2012-04-14 with total page 254 pages. Available in PDF, EPUB and Kindle. Book excerpt: Globalisation turns out to be untenable because it does not guarantee minimum social equity, peace and respect for the environment, and therefore does not guarantee the effective accomplishment of human rights. This book analyzes this issue and raises proposals for a new perspective. The first part describes the soft threats to human rights, derived from the devaluation of the politics and the productive economy with regard to the finance. It entails the concealment of the reality in the shape of exploitation as the tax havens and in the shape of marginalization of the persons with different abilities. The second part include a study of hard threats to human rights and examines two cases of failed states: Afghanistan and Somalia, in which the violence has supplanted the politics and the economy. In view of these situations it is necessary to rethink the force of classic ius gentium and the humanitarian right. The third part presents the European Union as a legal and political space in which conditions of a worthy life are better defended by means of the Primacy of Practical Reason and Social State of Law, and by the requirement of peace as the main rule of international relations.

Download or read book Il pensiero giuridico dal mondo classico al nuovo mondo written by Tito Lucrezio Rizzo and published by Gangemi Editore spa. This book was released on 2016-02-03T00:00:00+01:00 with total page 224 pages. Available in PDF, EPUB and Kindle.
