Este es un proceso que se inició por iniciativa de las propias empresas, que ante la presión de la sociedad optaron por poner en marcha procesos de control de sus proveedores y contratistas en todo el mundo, pero que adquirirá cada vez más consistencia a partir de la aprobación de los Principios Rectores de las Naciones Unidas sobre las Empresas y los Derechos Humanos y de diversas leyes nacionales dirigidas a imponer a las empresas el desarrollo de procesos de diligencia debida con ese objetivo.Consciente de que todos estos instrumentos cumplen una función común de garantía de esos derechos en los procesos globales de producción, este libro se propone aportar elementos para la construcción de una teoría jurídica que sea capaz de integrarlos en un todo coherente y dar cuenta de su aptitud para cumplir conjuntamente ese rol. La tesis que sustenta está representada por la progresiva conformación, a través del juego combinado de esa amplia gama de fórmulas reguladoras, de un nuevo Derecho Transnacional del Trabajo de las cadenas de valor, expresión del tránsito de un pluralismo anárquico y desordenado, como el que emergió espontáneamente a partir la actuación unilateral de las empresas, hacia un sistema de pluralismo ordenado, caracterizado por una cada vez mayor articulación de sus manifestaciones y una progresivamente más intensa confluencia de sus contenidos en torno a una serie de meta principios ordenadores.Este diagnóstico viene acompañado de la reconstrucción del modelo normativo que subyace al sistema de regulación del trabajo en el espacio global introducido por este nuevo Derecho, así como de la presentación de sus principales retos de futuro.

Frente a la expansión e impacto no actual, sino histórico de los grupos de empresas, los legisladores y los tribunales de justicia han venido intentando dotar de protección a los intereses de los múltiples agentes implicados y, a su vez -cuestión en ocasiones olvidada-, de un marco jurídico para su libre desarrollo en la medida en que son ejercicio de la libertad de empresa (art. 38 de la Constitución Española). -- Esta obra se centra en la aproximación que ofrece el Derecho del Trabajo Español a la problemática de los grupos de empresas y, en especial, en determinar si el modelo jurisprudencial español utilizado actualmente para identificar y atribuir responsabilidad laboral en el grupo de empresas es eficaz, efectivo y si responde a un criterio de eficiencia. El objetivo último de todo ello es determinar si dicho sistema jurisprudencial resulta adecuado para la protección de los trabajadores en España y si dota a los operadores jurídicos de seguridad jurídica en la materia. -- A tal efecto, el estudio realiza un actualizado, crítico y exhaustivo análisis normativo, dogmático y jurisprudencial desde el Derecho del Trabajo, el cual se ve complementado con el análisis de normas o instituciones de otras ramas del ordenamiento jurídico que abordan el fenómeno de los grupos de empresas, así como la incorporación de notas de Análisis Económico del Derecho.
