Book excerpt: Poetry. "Kenneth Goldsmith is without doubt the leading conceptual poet of this time. His poetry, which draws from Fluxus, Dada, and conceptual art traditions, is clever and self aware. With now classics such as FIDGET, SOLILOQUY, and DAY (all available form SPD), he has made poetry out of the mundane and when reading his work one is forced to reconsider the stakes and the measurements of aesthetic practice. THE WEATHER, a collection of weather reports, is one more test of poetry. And what is most striking about this book is that it aces the test. There is something wonderfully celebratory and shockingly pleasant and stimulatingly interesting about reading day after day of weather gone by"--Juliana Spahr.

Book The Work of Art in the Age of Mechanical Reproduction

Download or read book The Work of Art in the Age of Mechanical Reproduction written by Walter Benjamin and published by . This book was released on 2023-03-02 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Walter Benjamin discusses whether art is diminished by the modern culture of mass replication, arriving at the conclusion that the aura or soul of an artwork is indeed removed by duplication. In an essay critical of modern fashion and manufacture, Benjamin decries how new technology affects art. The notion of fine arts is threatened by an absence of scarcity; an affair which diminishes the authenticity and essence of the artist's work. Though the process of art replication dates to classical antiquity, only the modern era allows for a mass quantity of prints or mass production. Given that the unique aura of an artist's work, and the reaction it provokes in those who see it, is diminished, Benjamin posits that artwork is much more political in significance. The style of modern propaganda, of the use of art for the purpose of generating raw emotion or arousing belief, is likely to become more prevalent versus the old-fashioned production of simpler beauty or meaning in a cultural or religious context.

Download or read book Permanent Establishment written by Arvid Aage Skaar and published by Kluwer Law International B.V.. This book was released on 2020-06-19 with total page 957 pages. Available in PDF, EPUB and Kindle. Book excerpt: A new edition of the preeminent work on the permanent establishment (PE) is a major event in tax law scholarship. Taking into account changes in judicial and administrative practice as well as the Organisation for Economic Co-operation and Development’s (OECD’s) and the United Nation’s (UN’s) work in the three decades since the first edition, the present study brings the analysis up to date with the current internationally accepted interpretation of PE. The analysis is based on more than 720 cases from more than 20 countries, in addition to the OECD and UN model treaties and more than 630 books, articles, and official documents. The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept. The book provides many synopses of court decisions and administrative rulings upon which the analysis is based. In addition to cases previously published in law reports and other publications, a number of unpublished decisions are included. A key word index makes it easy to find what is needed in any particular matter. The PE principle, in one version or another, is used in several thousand tax treaties in force today. This updated comprehensive study reveals the obligations imposed through the use of PE in tax treaties and will continue to be of immeasurable value to tax practitioners and scholars worldwide. In addition, the discussion of whether the notion of PE is an appropriate criterion for taxing jurisdiction in international fiscal law today provides authoritative and insightful food for thought.

Book Oxford Handbook of Comparative Environmental Law

Available in PDF, EPUB and Kindle. Book excerpt: This Handbook is the first comprehensive account of comparative environmental law. It examines in detail the methodological foundations of the discipline as well as the substance of environmental law across countries from four vantage points: country studies from all continents, responses to common problems (including air pollution, water management, nature conservation, genetically modified organisms, climate change and energy, chemicals, waste), foundational components of environmental law systems (including principles, property rights, administrative and judicial organisation, command-and-control regulation, market mechanisms, informational techniques and liability mechanisms), and common interactions of environmental protection with the broader public, private, and criminal law contexts. 0The volume brings together the foremost authorities in this field from around the world to provide a concise, self-contained, and technically rigorous account of environmental law as a single overall system.

Book The Historical Foundations of the Narcotic Drug Control Regime

Download or read book The Historical Foundations of the Narcotic Drug Control Regime written by Julia Buxton and published by World Bank Publications. This book was released on 2008 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: Abstract: This paper outlines the institutional history of the international narcotic drug control regime. It details the evolution of the control system, from its foundations at the beginning of the twentieth century - a period of mass, unregulated narcotic drug use - to the current period. The paper argues that the contemporary control model is ill-positioned to address the dynamic and rapidly changing nature of the global narcotics trade. The persistence of anachronistic guiding first principles, specifically the utopian idea of prohibition, is identified as the key impediment to the adoption of a more humane and effective policy approach. But while there is growing pressure for a revision of founding ideas, this is not supported by a host of powerful actors that includes the United States.

Book excerpt: EU Environmental Law discusses the reality for legal practice throughout the EU, as environmental law of the Member States is becoming ever less 'national'. Consequentially European environmental regulation is becoming more complex and interrelated, making it an emerging field of study for European law graduates, and an area of increasing exposure to the legal profession. This book gives readers a thorough overview of core European environmental law, with a section on the basic framework and principles, as well as on substantive law issues giving insight into the legislation in the different sectors and the most topical developments.

Book The Habitats Directive in its EU Environmental Law Context

Download or read book The Habitats Directive in its EU Environmental Law Context written by Charles-Hubert Born and published by Routledge. This book was released on 2014-11-27 with total page 529 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyses the Habitats Directive; one of the most prominent piece of EU environmental legislation of the past decades. Seen by some as the cornerstone of Europe’s nature conservation policy, among other measures the Directive established the so-called "Natura 2000" ecological network, which covers more than 18% of the surface of the EU. However, despite the fact the Directive was adopted over twenty years ago only 17% of the protected habitats and species in Europe are being adequately protected while 10-60 % of animal species remain under threat. In light of the limited success and the contested nature of the Habitats Directive so far this book examines the successes and failures of the Habitats Directive from a legal and political angle. The book brings together international experts to consider the application, implementation and future of the Habitats Directive in order to assess whether the Habitats Directive is resilient enough to tackle biodiversity loss in the twenty- first century. Particular emphasis is put on the legal regime attached to the Natura 2000 network and its possible impact on land development and the relationship between the Habitats Directive and other topics including liability for ecological damage and transboundary nature conservation.
