Available in PDF, EPUB and Kindle. Book excerpt: Successive UK governments have pursued ambitious programmes of private sector competition in public services that they promise will deliver cheaper, higher quality services, but not at the expense of public sector workers. The public procurement rules (most significantly Directive 2004/18/EC) often provide the legal framework within which the Government must deliver on its promises. This book goes behind the operation of these rules and explores their interaction with the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE); regulations that were intended to offer workers protection when their employer is restructuring his business. The practical effectiveness of both sources of regulation is critiqued from a social protection perspective by reference to empirical findings from a case study of the competitive tendering exercise for management of HMP Birmingham that was held by the National Offender Management Service (NOMS) between 2009 and 2011. Overall, the book challenges the Government's portrayal of competition policies as self-evident sources of improvement for public services. It highlights the damage that can be caused by competitive processes to social capital and the organisational, cultural and employment strengths of public services. Its main conclusions are that prison privatisation processes are driven by procedure rather than aims and outcomes and that the complexity of the public procurement rules, coupled with inadequate commissioning expertise and organisational planning, can result in the production of contracts that lack aspiration and are insufficiently focused upon improvement or social sustainability. In sum, the book casts doubt upon the desirability and suitability of using competition as a policy mechanism to improve public services.

Book Freedom in the World 2014

Download or read book Freedom in the World 2014 written by Freedom House and published by Rowman & Littlefield. This book was released on 2014-12-11 with total page 885 pages. Available in PDF, EPUB and Kindle. Book excerpt: Freedom in the World, the Freedom House flagship survey whose findings have been published annually since 1972, is the standard-setting comparative assessment of global political rights and civil liberties. The survey ratings and narrative reports on 195 countries and fourteen territories are used by policymakers, the media, international corporations, civic activists, and human rights defenders to monitor trends in democracy and track improvements and setbacks in freedom worldwide. The Freedom in the World political rights and civil liberties ratings are determined through a multi-layered process of research and evaluation by a team of regional analysts and eminent scholars. The analysts used a broad range of sources of information, including foreign and domestic news reports, academic studies, nongovernmental organizations, think tanks, individual professional contacts, and visits to the region, in conducting their research. The methodology of the survey is derived in large measure from the Universal Declaration of Human Rights, and these standards are applied to all countries and territories, irrespective of geographical location, ethnic or religious composition, or level of economic development.

Book Appeal to the People s Court

Download or read book Appeal to the People s Court written by Vincent Luizzi and published by BRILL. This book was released on 2018-04-24 with total page 169 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Appeal to the People’s Court: Rethinking Law, Judging, and Punishment, Vincent Luizzi turns to the goings on in courts at the lowest level of adjudication for fresh insights for rethinking these basic features of the legal order. In the pragmatic tradition of turning from fixed and unchanging conceptions, the work rejects the view of law as a set of black and white rules, of judging as the mechanical application of law to facts, and of punishment as a necessary, punitive response to crime. The author, a municipal judge and philosophy professor, joins theory and practice to feature the citizen in rethinking these institutions. The work includes a foreword by Richard Hull, special Guest Editor for this volume in Studies in Jurisprudence.

Available in PDF, EPUB and Kindle. Book excerpt: San Quentin State Prison, California’s oldest prison and the nation’s largest, is notorious for once holding America’s most dangerous prisoners. But in 2008, the Bastille-by-the-Bay became a beacon for rehabilitation through the prisoner-run newspaper the San Quentin News. Prison Truth tells the story of how prisoners, many serving life terms, transformed the prison climate from what Johnny Cash called a living hell to an environment that fostered positive change in inmates’ lives. Award-winning journalist William J. Drummond takes us behind bars, introducing us to Arnulfo García, the visionary prisoner who led the revival of the newspaper. Drummond describes how the San Quentin News, after a twenty-year shutdown, was recalled to life under an enlightened warden and the small group of local retired newspaper veterans serving as advisers, which Drummond joined in 2012. Sharing how officials cautiously and often unwittingly allowed the newspaper to tell the stories of the incarcerated, Prison Truth illustrates the power of prison media to humanize the experiences of people inside penitentiary walls and to forge alliances with social justice networks seeking reform.

Download or read book Cutting Crime written by Great Britain. Parliament. House of Commons. Justice Committee and published by The Stationery Office. This book was released on 2010 with total page 232 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first report from the Justice Committee in the 2009-10 session and examines the subject of: "Cutting crime: the case for justice reinvestment" (HCP 94-I, ISBN 9780215543080). The report calls for a change in the way we tackle criminal justice and seek to cut re-offending. The Committee states that the criminal justice system faces a "crisis of sustainability" if resources continue to be absorbed by an ever-expanding programme of prison building rather than on preventing crimes from being committed, with prison building not being an effective long-term answer to coping with the already record-breaking prison population which is predicted to rise further. The average prison place costs £41,000 a year (plus further capital costs and health and education expenditure on top), with the Government's new prisons costing - on current estimates - up to £4.2 billion over the next 35 years. The Committee believes that a more "prudent, rational, effective and humane" use of resources is needed to shift the focus of expenditure away from incarceration and towards rehabilitation and prevention. This would involve investment in local education, health, drug, alcohol and community programmes in targeted areas based on analyses of where offences occur, where offenders live and "what works" in reducing offending. This is known as "justice reinvestment". Volume 2, contains oral and written evidence (ISBN 9780215543110).
