Author Esteban Donoso addresses this question in A Global Solution for the Protection of Inventions. Sharing the results of an extensive study, Donoso analyzes the legal nature of intellectual property, industrial property, and patents and reviews the evolution and background of the current global legal scenario of the protection of inventions. The study also identifies the main flaws, strengths, and virtues of the current system and examines the international instrument governing patents. Donoso then introduces a corrective action plan and addresses the compatibility of the proposal in regard to free trade, technology transfer, and the least possible market distortion. A Global Solution for the Protection of Inventions seeks to correct the deficiencies that exist in the current patent system by introducing a differentiated protection period granted by a patent according to the economic capacity of each country and demonstrates that this action is necessary to make the global agreement governing the system just and effective.

El volumen se inicia con la contribución de la Doctora Marta Fernández Martínez, Vicedecana de la Facultad de Derecho de la Universidad de La Habana, que ilustra acerca del proyecto de investigación donde se insertan las Jornadas y da la bienvenida a los participantes en ella. A continuación, aparece la conferencia magistral ofrecida por el Doctor Carlos Rogel Vide, Catedrático de la Universidad Complutense de Madrid, fundador y actualmente Miembro de Honor de la Asociación para el Estudio y la Enseñanza del Derecho de Autor (ASEDA) sobre los bienes inmateriales como objeto de los derechos. En segundo lugar se recoge el trabajo presentado por la Doctora Marta Moreno Cruz, Decana de la Facultad de Derecho de la Universidad de La Habana, que trató acerca de la originalidad y la novedad como requisitos para la protección jurídica, particularizando en los modelos de utilidad y las obras derivadas. Luego, el trabajo de la Doctora Dánice Vázquez de Alvaré, Profesora de la Facultad de Derecho de la Universidad de La Habana, incursiona en las obras de arte aplicadas y los diseños industriales. Seguidamente, se incluye la conferencia de la Doctora Caridad Valdés Díaz, Profesora de la Facultad de Derecho de la Universidad de La Habana y Miembro de Honor de ASEDA, sobre la relación existente entre títulos de las obras, signos distintivos y competencia desleal. Continúa esta obra con un trabajo que nos acerca al régimen jurídico de las invenciones y obras de funcionarios, empleados y asalariados, presentado por el Doctor Eduardo Serrano Gómez, Profesor Titular de Derecho civil de la Universidad Complutense de Madrid y Presidente de ASEDA. Más adelante, aparece el trabajo expuesto por la Doctora Elena Vicente Domingo, catedrática de Derecho civil y Vicerrectora de la Universidad de Burgos, España, que ofrece una panorámica de la vulneración de propiedad intelectual e industrial y el estado de la cuestión en materia de daños. Le sigue, la conferencia a cargo del Doctor José Antonio Vega Vega, catedrático de Derecho civil de la Universidad de Extremadura, sobre los delitos en materia de propiedad intelectual, especialmente el plagio de las obras, y los delitos contra la propiedad industrial. Finalmente, cierra el presente volumen el trabajo del Doctor Abel Martín Villarejo, Director General de AISGE, Vicepresidente de ASEDA y Profesor de la Facultad de Derecho de la Universidad Complutense de Madrid, acerca del Derecho de la Unión Europea y el Derecho Internacional en materia de Propiedad industrial y Derecho de autor, destacando las áreas comunes y fronterizas entre el copyright y la propiedad industrial.

Book excerpt: Patent infringement procedures are an instrument whereby the patentee defends his protected invention against unlawful use by a third party (the alleged infringer). The difficulty is that the patent is no solid object whose damage can be easily detected; it belongs to that group of rights whose infringement is not easy to determine. The patent is a right described by words, and those words, written into a claim, are so complicated that laymen and lawyers alike fail to understand them. This is the special feature which distinguishes the patent right. This book consists of a series of country reports in which expert patent attorneys describe the patent infringement procedures in their jurisdiction. Since the first edition of this book was published in 2000, developments in the field of patent enforcement have been significant and required a major rewriting of all the seven original contributions (the UK, Germany, France, the Netherlands, Italy, Japan and the US): more than 100 decisions have been added. For the second edition, another eight countries have been included: three from Eastern Europe (Poland, the Czech Republic and Hungary), two from Asia (China and Korea), two from Latin America (Argentina and Brazil), and one from Europe (Switzerland) and there is a new chapter by Dieter Stauder on European issues of patent enforcement: cross-border litigation, cross-border assistance in obtaining evidence, and the new European Enforcement Directive.

On the basis of rich empirical material, the analysis traces state discourses and practices and mechanisms to govern 'ancestral knowledges' in the framework of the government's Knowledge Society project and delineates how leaders of peoples and nationalities' organisations struggle for the decolonisation of knowledge. This monograph will be of interest to those concerned with relations between peoples and nationalities and Latin American states, politics of recognition and collective rights, the workings of purportedly post-neoliberal governments and the possibilities and limits for alternatives to development, the struggle of peoples and nationalities' organisations for (epistemic) decolonisation, as well as ongoing (re-)conceptualisations of cosmopolitanisms against restructurations of the coloniality of knowledge and being.
