Book excerpt: Questo mio lavoro di approfondimento sulle novità in materia di valutazione delle performance del personale del pubblico impiego è nato a seguito di un interesse suscitatomi dalla trattazione delle tematiche relative alla riforma Brunetta, nell’ambito di un seminario di livello universitario promosso dalla Scuola Superiore di Pubblica Amministrazione e svoltosi nello scorso dicembre 2009. Il particolare argomento trattato ha subito suscitato la mia attenzione, in quanto caratteristico “trait d’union” tra la mia formazione scientifica di ingegnere gestionale – orientata ai risultati e all’ottimizzazione di tempi, costi e risorse – e il mio attuale impiego c/o un ente pubblico. Partendo da un breve excursus tecnico normativo si è voluto analizzare il processo di privatizzazione del pubblico impiego, che vede nella riforma Brunetta in generale e nel sistema di valutazione delle performance del personale nel particolare, il culmine della realizzazione fin’ora realizzatasi in tale ambito. Il cuore del presente lavoro sta nell’approfondire la riforma del pubblico impiego “zummando” sul concetto di performance e del sistema di valutazione dei dipendenti, analizzandone gli aspetti tecnici, economici nonché proposte di miglioramento e lavori di sperimentazione.

People increasingly invest in relationships falling outside the model of the marital family, such as non-conjugal unions of friends or relatives, polyamorous relationships and various religious-based families. Despite this, Western jurisdictions retain the marital family as the relevant basis for allocating family law benefits, rights and obligations. Part I of the book illustrates recent evolutions in family patterns and norms, and explores how law can accommodate multiple family grids without legal recognition involving normalisation. Part II focuses on courtroom litigation on the basis that courts nowadays are central avenues of social change. It takes non-conjugal families as a case study and provides an analysis of the most compelling argumentative strategies that non-conjugal families can mobilise to pursue legal recognition in Canada and the United States, and within the systems of the European Convention of Human Rights and the European Union. Through its comparative, interdisciplinary and critical legal method, the book provides scholars, activists and policymakers with conceptual tools to tackle the current invisibility of new families. The book also explores the rights recognisedby the EU Charter of Fundamental Rights to persons in need of international protection, inclusive of the principle of non-removal to a place of persecution, the prohibition of ill-treatment, the right to asylum, and the right to effective judicial protection.The fundamental focus of the book is the relationship between the aforementioned border and migration controls and the rights of asylum seekers, and importantly, how these rights limit the nature of such control measures and the ways in which they are implemented.
