Pour autant, le droit international de l'environnement est un laboratoire hautement pertinent d'analyse des techniques normatives. Les travaux positivistes qui lui sont consacrés permettent d'appréhender et de connaître ce corpus juridique. Ils mettent en lumière les techniques normatives usités, à savoir l'ensemble des procédés, fondés sur des connaissances scientifiques, employés pour produire une œuvre et obtenir un résultat déterminé. Ces techniques normatives concernent tout à la fois la production du droit, telles les conventions-cadres ou les obligations différenciées, et sa réalisation avec notamment les mécanismes de compliance. Ces mécanismes de contrôle du respect des obligations promeuvent l'adoption de réactions adaptées aux causes du manquement aux obligations juridiques. Ils peuvent ainsi constituer des modèles pour une justice plus efficace. Plus largement, les travaux ouvrent la voie à des connaissances qui dépassent cet objet juridique en identifiant et analysant les évolutions plus larges connues par le droit aujourd'hui. Il s'agit notamment du phénomène de soft law (droit mou ou souple) ainsi que de l'analyse du droit sous la figure du réseau et non plus seulement de la pyramide normative.

Arguably, the topic’s low profile is due to the mostly uncontroversial nature of the field’s distinction between procedural and substantive obligations. Furthermore, the vast majority of environmental law scholars and practitioners have tended to welcome the procedural features of multilateral environmental agreements and their potential to promote regime evolution and effectiveness. However, recent developments have served to put the spotlight on certain aspects of the procedure substance topic. ICJ judgments revealed ambiguity on aspects of the customary law framework on transboundary harm prevention that the field had thought largely settled. In turn, in the treaty context, the Paris Agreement’s retreat from binding emissions targets and its decisive turn towards procedure reignited concerns in some quarters over the “proceduralization” of international environmental law. The two developments invite a closer look at the respective roles of, and the relationship between, procedure and substance in this field and, more specifically, in the context of harm prevention under customary and treaty law.
