Book The WTO and Technical Barriers to Trade

Download or read book The WTO and Technical Barriers to Trade written by Spencer Henson and published by Edward Elgar Publishing. This book was released on 2005 with total page 568 pages. Available in PDF, EPUB and Kindle. Book excerpt: This authoritative volume brings together for the first time the foremost research and commentary on technical barriers to trade. It explores the major theoretical issues associated with analysis of the impact of technical measures on trade in goods and the challenges associated with attempts to quantify impacts on trade flows. Previous empirical analyses of the impact of technical barriers on trade in goods in general are then presented. This is followed by in-depth coverage of the trade effects of sanitary and phytosanitary (SPS) measures, an area where analysis is particularly challenging. Finally, the volume concludes by exploring institutional efforts to overcome the impact of technical barriers, including harmonization of standards and the role of the WTO. The WTO and Technical Barriers to Trade will be an invaluable source of reference for academics, students and policymakers alike.

Download or read book The Trading System After the Uruguay Round written by John Whalley and published by Washington, DC : Institute for International Economics. This book was released on 1996 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are growing pressures to reform the international trading system beyond whatever is accomplished in the Uruguay Round. This study assesses the present GATT system and concludes that the need for further reform is far-reaching. Whalley finds that the principles underlying the current system - nondiscrimination and multilateralism - will not adequately serve in the future to reduce trade barriers and promote the benefits of trade. The study outlines new approaches to reduce the level of protection and harness new regional trading arrangements to improve global economic performance.

Available in PDF, EPUB and Kindle. Book excerpt: The completion of the Uruguay round promised a new era in international trading relations. However, there remains a wide range of issues which could threaten international trading stability, including regionalisation and regionalism, increased non-tariff forms of protection and the proliferation of unilateral and bilateral trade deals. It concludes with an assessment of the long-term possibilities for creating a mutually beneficial world economic system.

Book The Role of Science in the Uruguay Round and NAFTA Trade Disciplines

Download or read book The Role of Science in the Uruguay Round and NAFTA Trade Disciplines written by David A. Wirth and published by . This book was released on 1994 with total page 76 pages. Available in PDF, EPUB and Kindle. Book excerpt: This article examines the increasingly important role of science in the structure and operation of international trade agreements. Indeed, under the recently completed Uruguay Round of Multilateral Trade Negotiations under the auspices of the General Agreement on Tariffs and Trade 1 (Uruguay Round) and the trilateral North American Free Trade Agreement 2 (NAFTA), the presence and integrity of scientific support is a principal touchstone for determining the legitimacy of many national regulatory efforts aimed at assuring environmental integrity or safeguarding public health. More particularly, the analysis in this article is intended to highlight the quiescent issues at the interface between science and governmental regulatory policies that are raised by the emphasis on scientific validity in the Uruguay Round and the NAFTA.

Book Implementation of Uruguay Round Commitments

Download or read book Implementation of Uruguay Round Commitments written by Joseph Michael Finger and published by . This book was released on 2016 with total page 58 pages. Available in PDF, EPUB and Kindle. Book excerpt: At the Uruguay Round, developing countries took on obligations not only to reduce trade barriers but also to undertake significant reforms of regulations and trade procedures. The Round did not, however, take into account the cost of implementing these reforms - a full year's development budget for many of the least developed countries - nor did it ask whether the money might be more productive in other development uses.At the Uruguay Round, developing countries took on unprecedented obligations not only to reduce trade barriers but to implement significant reforms both of trade procedures (including import licensing procedures and customs valuation) and of many areas of regulation that establish the basic business environment in the domestic economy (including intellectual property law and technical, sanitary, and phytosanitary standards. This will cost substantial amounts of money. World Bank project experience in areas covered by the agreements suggests that an entire year's development budget is at stake in many of the least developed countries. Institutions in these areas are weak in developing countries, and would benefit from strengthening and reform. But Finger and Schuler's analysis indicates that the obligations reflect little awareness of development problems and little appreciation for the capacities of the least developed countries to carry out the functions that these reforms of regulations and trade procedures address. The content of these obligations can be characterized as the advanced countries saying to the others, Do it my way! Moreover, these developing countries had limited capacity to participate in the Uruguay Round negotiations, so the process has generated no sense of ownership of the reforms to which membership in the World Trade Organization obligates them. From their perspective, the implementation exercise has been imposed imperially, with little concern for what it will cost, how it will be carried out, or whether it will support their development efforts. This paper - a product of Trade, Development Research Group - is part of a larger effort in the group to support effective developing country participation in the WTO system. This research was supported by the global and regional trust fund component of the World Bank/Netherlands Partnership Program.

Book WTO Technical Barriers and SPS Measures

Download or read book WTO Technical Barriers and SPS Measures written by Rüdiger Wolfrum and published by BRILL. This book was released on 2007-05-30 with total page 597 pages. Available in PDF, EPUB and Kindle. Book excerpt: Technical standards are increasingly determining the development, production, trade in and marketing of goods and services. In order to ensure that technical regulations and product standards which vary from country to country do not create unnecessary obstacles to trade the Agreement on Technical Barriers to Trade was adopted during the Uruguay Round. It is paralleled by the Agreement on Sanitary and Phytosanitary Measures which sets out the basic rules on how governments can apply food safety as well as animal and plant health measures without, however, using them as an excuse for protecting domestic producers. Prominent decisions under the WTO Dispute Settlement have interpreted those provisions. This volume gives a detailed account of the necessary parameters for technical standards and measures seeking to protect health and environment. Included are commentaries on Articles III, XI and XX of GATT 1994 which are equally relevant in this context. The article by article commentaries draw from a considerable body of case law, the work by the TBT and SPS Committee and the relevant legal literature. Attention is given to substantive requirements as well as the necessary standard setting procedures. Apart from a thorough analysis of the relevant and most recent jurisprudence including the Biotech Panel Report the commentary seeks to give answers to newly emerging issues, such as special needs of developing countries. It is an indispensable tool for practitioners and academics working in this field of WTO law.
