This book offers a comprehensive overview of the historical basis and status of the requirement for indigenous peoples’ consent under international law, examining its relationship with debates and practice pertaining to the acquisition of title to territory throughout the colonial era. Cathal Doyle examines the evolution of the contemporary concept of FPIC and the main challenges and debates associated with its recognition and implementation. Drawing on existing jurisprudence and evolving international standards, policies and practices, Doyle argues that FPIC constitutes an emerging norm of international law, which is derived from indigenous peoples’ self-determination, territorial and cultural rights, and is fundamental to their realization. This rights consistent version of FPIC guarantees that the responses to questions and challenges posed by the extractive industry’s increasingly pervasive reach will be provided by indigenous peoples themselves. Book excerpt: This review, for the first time to date, analyses the potential of labelling and certification schemes for Indigenous Peoples to market their food products. Specifically, it looks at those schemes that are designed by, with and for Indigenous Peoples, and that can provide economic, social and environmental benefits while protecting and promoting their unique values centered around the respect of life and Mother Earth. Eleven examples in this review cover innovative schemes implemented by Indigenous Peoples and practitioners in Africa, Asia, Central and South America and Oceania. They include territorial labels, geographical indications (GI), and participatory guarantee schemes (PGS), among others. In addition, the publication features one case study of a community-supported agriculture (CSA), as alternative example to engage with Indigenous Peoples and reaching out the market. Important factors that lead to the success of different schemes include (1) the leadership and ownership of Indigenous Peoples in the initiative (2) adequate support by external stakeholders including public and private sector, and universities (3) raising consumer awareness and education on Indigenous food products via fairs, festivals and other platforms, and (4) designing value chains and policies in a way that harmonize local, domestic and international trade. The review includes recommendations for various actors to support Indigenous Peoples in their self-determined economic development and towards the sustainable marketization of their products. The review also provides guidelines for Indigenous Peoples willing to engage in such initiatve. Those are applicable to different contexts on the ground, and include good practices, and measures to mitigate risks.

It provides an in-depth consideration of the key thematic areas within WIPO discussions – genetic resources (GRs), traditional knowledge (TK) and traditional cultural expressions (TCEs) through the perspectives of a broad range of experts and stakeholders, including indigenous peoples and local communities. It also looks at how these areas have been treated in a number of forums and settings (including national systems and experiences, and also in trade agreements) and the interface with WIPO discussions. Furthermore, the book analyses the process and the negotiation dynamics since the IGC received a mandate from WIPO members, in 2009, to undertake formal text-based negotiations towards legal instruments for the protection of GR, TK and TCEs. While there has been some progress in these negotiations, important disagreements persist. If these are to be resolved, the adoption of these legal instruments would be a significant development towards resolving key gaps in the modern intellectual property system. In this regard, the book considers the future of the IGC and suggests options which could contribute towards achieving a consensual outcome.

Book excerpt: For centuries, fishing has been an activity of great importance for indigenous peoples. They inhabit and relate to water ecosystems, which conserve their cultural heritage, food sovereignty (the right to access healthy and culturally appropriate food) and in many cases are a main source of income. In Central America the situation is not different: today indigenous peoples live in more than 75% of the marine-coastal zones of the Caribbean Sea and extensive areas adjacent to continental waters and the Pacific Ocean, and have in fishing their main incomes. Precisely these areas present the highest indicators of poverty and malnutrition in the region. Taking this context into account, FAO and FILAC joined forces to promote the implementation of the voluntary guidelines for the sustainability of small-scale fisheries (DV-PPE) in the context of food security and the eradication of poverty. They organized the international course "Voluntary Guidelines for the Sustainability of Small Scale Fisheries in the Context of Food Security and the Eradication of Poverty for Indigenous Peoples of Central America". During the course, government representatives, indigenous leaders and indigenous fishermen from six countries (Costa Rica, El Salvador, Guatemala, Honduras, Panama and Nicaragua) gathered to learn, share, advocate, dialogue and build a roadmap to implement in their countries.
