Book excerpt: English Abstract: In 2012-2013, the Ontario government and teacher unions engaged in collective bargaining. The government was committed to imposing a wage freeze and modifying other terms of the collective agreement. The teachers were determined to limit any rollback of benefits. The negotiations occurred in the shadow of a variety of social, economic, and legal influences including the government's desire to control its deficit, a growing clamour to control public-sector employee wages and benefits, and ambiguity about the constitutional protections for collective bargaining provided by the Canadian Charter of Rights and Freedoms. Ultimately, the government resorted to enacting legislation giving it the power to impose collective agreements. This article provides an account of how the parties navigated the legal space within which collective bargaining took place, especially how the ambiguities around the Charter of Rights served to structure the choices made by the parties. It concludes that the unions' exercise of political influence, as much as reliance on Charter rights, served to dampen the deleterious impact of the government's agenda.

Available in PDF, EPUB and Kindle. Book excerpt: Between 1975 and 1997, school teacher bargaining was conducted under the School Boards and Teachers Collective Negotiations Act (Bill 100). By most accounts, the teacher bargaining law was successful in promoting bilateral settlements with minimal strike activity. Following its election in 1995, the Harris government reduced public expenditures and introduced educational reforms. In doing so, it repealed Bill 100 and passed laws restricting teacher bargaining. These measures ranged from imposing restrictions on the scope of negotiable issues to attempts to make “voluntary” extracurricular activities mandatory. This study finds that the government's blunt and heavy-handed efforts to control collective bargaining processes and outcomes, not only proved futile, but led to an increase in work stoppages and protracted guerilla warfare at the school board level.
