Book excerpt: Proposition 13 and successive state constitutional limitations on property taxes put California cities in a fiscal bind. Cities responded by making developers pay “up front” for the cost of infrastructure and other public services. Impact fees, affordable-housing mandates and ad-hoc exactions were tools of the trade. This fiscal model is increasingly at war with the state's goal of ramping up housing production. In San Francisco, for example, the stack of fees and related mandates--in combination with softening rents and rising construction costs--have rendered housing development economically infeasible, notwithstanding that the city's rental market remains one of the least affordable in the nation. This short essay proposes an alternative to impact fees that would serve cities' fiscal needs without deterring development: a progressive parcel tax levied on the allowable building envelope created by an upzoning ordinance. Our proposal has a near precedent in the so-called Mello-Roos taxes used by suburban developers to finance infrastructure for tract-home subdivisions. Given that state law prioritizes infill development, it's high time that the Mello-Roos model be adapted and extended for urban use.

Book excerpt: Over the past two decades Americans have become increasingly skeptical about the benefits of community growth and hostile to new taxes--while continuing to demand improvements in local services. One response to this tension has been a burgeoning movement to raise public revenue by regulating growth. In this timely book, the authors explain that most growing localities now require private developers to finance public improvements as a condition for receiving permits to build. These permit conditions, known as "exactions," are most commonly used to ensure that infrastructure capacity will be adequate to serve the occupants of new real estate developments and to lessen the harmful effects of these developments on other local citizens. Exactions are often used to finance new roads, water and waste disposal facilities, and public open space, but some communities have begun to require developer financing for such services as day care, job training, low-cost housing, and ride sharing. The authors see the dramatic growth of exaction financing as an epochal shift in the character of American land use regulation. A function once isolated from the local government mainstream is now close to heart of fiscal and public works decisionmaking. Politicians find exactions an extremely valuable tactic for resolving land use conflict. Lawyers and developers worry about how to establish appropriate limits on the use of exaction, economists debate their equity and efficiency, and planners consider their effect on urban reform. Regulation for Revenue offers an integrated appraisal of exaction financing, showing that exactions come in many forms and that they can be meaningfully evaluated only by comparison with realistic alternatives. These include growth restrictions, tolerance of infrastructure overload, and increased tax and user charges.

Land use regulatory reform can play an important role in addressing these issues. But, the evolution, determinants, and effects of land use regulations remain unclear. I use Los Angeles as a case study to answer important questions about why and how land use regulations matter. I organize the dissertation as three related but independent papers. The first paper characterizes how land use regulations change. In Los Angeles, zoning designations were largely static between 2002 and 2014; the city rezoned only about two percent of its parcel land area during this period. While rezonings were uncommon, the city adopted new land use regulations or expanded existing regulations, including several transit-oriented development plans, a density bonus ordinance, an adaptive reuse ordinance, and the expansion of historic preservation overlays. In general, this illustrates a bifurcated evolution of regulations. Single-family neighborhoods remain protected, while significant changes occur in downtown Los Angeles and some high-density neighborhoods near transit. The second paper examines why zoning is changed. I use logistic regression models to analyze the relationship between parcel-scale "upzoning" and housing demand factors, supply constraints, the influence of interest groups, and municipal policy drivers. I find that upzoning in Los Angeles follows the path of biggest opportunity and least political resistance. My research supports the "homevoter hypothesis," meaning that concentrations of homeowners deter zoning changes to allow higher densities. The third paper explains how regulations matter for housing production. Using negative binomial regression models, I find strong associations between high-density zoning and multifamily housing production across Los Angeles. In the city's oldest transit-oriented development (TOD) plan area, the average multifamily development was built at 132% of the baseline allowable residential density, 107% of the allowable floor area ratio, and 102% of the allowable height. The regression results and the TOD analysis provide evidence that developers would build more densely, in neighborhoods with housing demand, if land use regulations were more permissive.
