Book excerpt: The problem of the Agunot (literally: chained women, women whose husbands refuse to divorce them) and the need to find an Halakhic solution to resolve their suffering has occupied Halakhic authorities throughout the ages. Lately, the problem of husbands who refuse to divorce and brothers-in-law who refuse to absolve widows from Levirate marriage has become far more acute both in Israel and in the diaspora for a variety of reasons. Some even regard it as the most severe Halakhic problem to occupy Halakhic authorities today and this is most certainly so in the field of marital relations. Various Halakhic solutions have been considered at different times, but most of these have been rejected by contemporary authorities In this research, we would like to present a little-known possible Halakhic solution - Temporary Marriage - in its two possible forms. We will consider its roots and the different applications of this solution in Talmudic sources, in both the Palestinian Talmud and the Babylonian Talmud, where there is a more detailed discussion. The two variations are, a premarital condition which will be used where the widow becomes liable for a levirate marriage and a Temporary Marriage to be agreed by the two sides. An example of the Babylonian application of this solution is the cry by important Babylonian Amoraim - “Who wants to marry me for day/s”. In these two cases, some of the Halakhic authorities rule that there is no necessity for a Get in order to terminate the marriage. We will consider the early Halakhic rulings in these cases and the modern version of this suggestion, which was also rejected by modern Halakhic authorities. We will also undertake a comparative study of a possible parallel to the marriage for a pre-determined period - the Shi'ite Temporary Marriage, which is intentionally restricted to an agreed period of time and does not require divorce to annul it. We will conclude our discussion by revealing the possible common roots for the Temporary Marriage and the Shi'ite Temporary Marriage in ancient Persian law.

Since the twelfth century Halakhic decisors have ruled that a Jewish woman may not institute a legal action for divorce in rabbinic courts. That law is in effect today in Orthodox Judaism. The thesis of this work is that Rabbenu Tam's was a minority opinion, and that the mechanism for permitting wives to initiate and carry through divorce proceedings exists--if we are willing to use it. Such a mechanism may also provide a solution to one of the most tragic and vexing problems of modern Orthodox family life--the plight of those thousands of women whose husbands refuse them a religious divorce though they themselves have remarried after receiving a civil decree. In an appendix, Rabbi Riskin presents his version of a premarital agreement designed to prevent this situation from occuring.

The thesis of this book is that the agunah problem in contemporary America is part of a more general dispute in classical Jewish law as to when marriage should end. Thus, this book surveys how Jewish law seeks to respond to the consent of the other party or without a finding of fault. It concludes by noting that prenuptial agreements can successfully address the agunah problem in the United States since they provide a way for couples to create an image of marriage and divorce by which they can agree to live. Michael J. Broyde is an Associate Professor of Law at Emory University and the Academic Director of Law and Religion Program at Emory University. He is a member (dayan) in the Beth Din of America and was the director of that Beth Din while on sabbatical from Emory. In addition, he is the founding rabbi of the Young Israel synagogue in Atlanta. Whether this is one of them is not for me to say. But for sure, this work is unique in at least three ways. Books on public issues tend to focus on one major topic. This one covers a series of unrelated subjects. Also, many political thinkers first take positions on a series of issues and then form their overarching beliefs accordingly. The chapters herein are mainly based on preexisting theoretical ideas, and those concepts then guide the positions formulated. Finally, the book's ideas are mainly taken from classical Jewish wisdom which - together with the Jewish Nation - has survived intact for millennia.I tried very hard to make this reader-friendly to all people, including those with no knowledge of Judaism and Talmud. Nevertheless, Talmudic thinking is subtle and nuanced and, therefore, easily misunderstood. In fact, the Talmud (Chagiga 9b) advises that studying its texts 101 times is far better than doing so "only" 100 times. As a practical matter, it might be helpful to read the segments more than once. I also advise reading the entire Foreword before proceeding on to the chapters (which can then be covered in any sequence).I wrote this book intermittently over several years. It was first published it in 2012 and later edited and expanded a few times, especially for this first-ever Revised Edition. As such, one page might dwell on what is "now" taking place in 2011, and the next page discusses 2018. It also deals with ongoing events that quickly evolve. A conundrum arose. Should I update the dates and events in cases when doing so would have no bearing on the ideas discussed? That would have entailed a lot of meaningless rewriting, so I didn't make those revisions. I hope it doesn't prove confusing to the reader. (Taken from the author's introductory note)
