Book Synopsis of the Law of Nations Vol 2 Classic Reprint

Download or read book Synopsis of the Law of Nations Vol 2 Classic Reprint written by Johann Wolfgang Textor and published by Forgotten Books. This book was released on 2017-12-14 with total page 374 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Synopsis of the Law of Nations, Vol. 2 The discussion in subsequent chapters of questions relating to the Law of Nations is more frequently based on the principles of private law, and therefore does not do justice to the real needs and relations of the Law of Nations. Likewise, Textor has not altogether avoided the mistake of mixing up law and morality, a mistake due to his assuming the immediate existence of a Law of Nature - which must not be confounded with the argument based on the nature of the thing, an argument which considers certain definite relations as of an undoubtedly positive character it is this mixing up of law and morality that accounts for his drawing a juridical distinction between bellum justum and helium injustum. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Institutes of the Law of Nations, Vol. 2 of 2: A Treatise of the Jural Relations of Separate Political Communities Whilst such is our attitude, it is not surprising that the investigators of nature in other directions should despise us; that even our own self-respect should be shaken; and that, whilst legislation is honoured as the highest function of the citizen, and the profession of the law enjoys every consideration, the Science of Law should hang its head, and the Faculties of Law in our Universities, where we have them at all, should drag ignominiously at the tail of the academical system. Against this condition of affairs I have made it the chief occupation of my life to protest; and now that I am approaching the close of my labours, my only regret is that I have not protested with greater earnestness and power. It has sometimes occurred to me that the exceptional position of English jurists in this matter may be more apparent than real, and may have arisen from an unhappy accident which has checked the progress - or at all events the conscious progress - of jurisprudence in England along the lines which it has followed in Continental countries. Neither Bentham nor Austin received a learned education as jurists, however it may have stood with them in other respects, and they had no acquaintance with mental philosophy. Book excerpt: Excerpt from The Law of Nations: Or, Principles of the Law of Nature, Applied to the Conduct and Affairs of Nations and Sovereigns Many years have elapsed since the original work was pub lished, lon g before the invaluable decisions of Sir William Scott, Sir C. Robinson, and Sir J ohn N ichol, and other emi nent J udges in the Courts of Admiralty, and Prize and other Courts; and the last edition, upon which any care was be stowed, was published in A. D. 1797; since which time, and especially during the last general war, many most important rules respecting the Law of Nations were established. The object of the present Editor has, therefore, been to collect and condense, in numerous notes, the modem rules and decisions, and to fortify the positions in the text by references to other au thors of eminence, and by which he hopes that this edition will be found of more practical utility, without interfering with the text, or materially increasing its size. Book The Law of Nations

Download or read book The Law of Nations written by Travers Twiss and published by . This book was released on 2015-07-05 with total page 582 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Nations: Considered as Independent Political Communities The object, which the author has had in view in undertaking to treat of the Law of Nations, has been to present to the student of that branch of International Law, which is conversant with the Eights and Duties of Nations as Independent Political Communities, a systematic outline of the existing rules of international conduct, by which the harmony of the National State-System of Christendom is maintained, and to the advantages of which the Ottoman Empire was admitted by the Treaty of Paris(1856). The author makes no pi-etension to discuss any theories of International Ethics, as furnishing rules, by which the intercourse of independent States ought to be guided. He has been content to examine into the existing usages of State-Life, and to illustrate the modifications and improvements which they have undergone from time to time, whereby they have been adjusted to the growing wants of a progressive civilisation. This book was released on 2018-03-03 with total page 394 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A History of the Law of Nations, Vol. 1 In this last connection I would say that, in spite of much criticism, I have pursued my former practice of constant citation. I have recourse to citation, not only as pointing to the sources of my personal authority for particular statements, but as directing to stores of further information which might possibly otherwise escape the student who would prosecute research into wider fields. I have, moreover, no desire to affect originality where the merit has been that of another. I would remark with regard to the method I have followed in confining attention in the volume now issued to the inter national relations of Europe, that I am far from disregarding thereby the claims which might be preferred in a History of Civilisation on behalf of certain States of the East. Indeed I would express my belief that an examination initiated into the history of China and Japan, of Persia and of India - an ex amination which I have some hope may be ere long initiated by one better qualified for the work than myself-would reveal the fact that the recent appearance of one at least of the peoples of the Orient amongst the States of the International Circle represents but the renewal of a connection severed by long centuries of Barbarian cleavage. Book excerpt: Excerpt from The Law of Nations: Considered as Independent Political Communities; On the Rights and Duties of Nations in Time of War The Author has endeavoured, in treating of the Rights and Duties of Nations in time of War, to observe, as far as the subject would permit, the same method of investigation, which he has found eminently convenient in discussing the Rights and Duties of Nations in time of Peace. He has accordingly sought to ascertain under each head the leading Principles, which lie at the foundation of the Law, by an historical analysis of the Practice which has prevailed amongst Nations at various times, as the earlier Practice will be found in most instances to disclose some general Principle, based upon an absolute view of Belligerent Right, the application of which has become modified in modem Practice, either under the civilising influence of Commerce, or in deference to some conflicting Right of Neutrals. This book was released on 2017-11-10 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commentaries on the Law of Nations Law is still in some measure the study of the bar, while the Scotch bar has produced no treatises upon the Law of Nations. But the absence of a resident court in Scotland during two centuries, has removed the cognizance of international questions to the English seat of legislature and I think that as far as Scotland proves anything, it is in favour of the above observations, as the love of abstract reasoning is more common among the Scotch than among the English, being, as on the continent, co-existent with the habits of the study of the Roman Law, if it be not the consequence of that study. Book excerpt: Excerpt from The Law of Nations, Investigated in a Popular Manner A number of questions, have been publicly offered, to be answered by a correspondent of the Aurora. To do justice to the subjects embraced by those questions, it would, be necos sary to possess the ability, industry, and the volume of an histo rian; they comprise not merely a history of our own country, but an important part of that of Europe, for several centuries. As a simple correspondent for a daily newspaper, I can barely Offer some general remarks upon each question, and in as plain a manner as possible. Perhaps my attempt may induce those. Now that it has been raised aloft, follow it. Follow it even to the battle front. It goes on a high mission. The land over which it flies inherited its spirit of freedom from a race that had practiced liberty for a thousand years. And the daughter paid back the debt to the mother. Her successful practice of free institutions caused the civic stature of the citizen in the mother-land to grow. It lit the torch of liberty in France. Then, moving abreast, these three lands of democracy imparted to it impetus so resistless that freedom is sweeping victorious round the globe.
