One part of the broader criminal justice response is the sentencing, and management under sentence, of family violence offenders. In March 2016, the Royal Commission into Family Violence recommended that the Sentencing Advisory Council ('the Council') examine one aspect of sentencing and managing family violence offenders, namely 'the desirability of and methods for accomodating "swift and certain justice" approaches to family violence offenders in Victoria's sentencing regime' (Recommendation 83). Subsequently, in September 2016, the Attorney-General requested such advice from the Council in the form of terms of reference, and this report constitutes the Council's response to those terms. - p.ix.

Book excerpt: This book presents a detailed analysis of Hawaii’s Opportunity Probation with Enforcement (HOPE) program. Developed by Judge Steven Alm in Hawaii in 2004, this model of ‘swift, certain and fair’ justice has been widely adopted across the United States. The book argues that although HOPE has principally been viewed in terms of its deterrent impact, it is in fact best understood through the lens of therapeutic jurisprudence and solution-focused courts, especially drug courts. Bartels presents a detailed overview of HOPE’s operation, as well as a critical assessment of the evaluation findings of HOPE and other programs based on this model. Crucially, the book draws on observational research to demonstrate that much of the commentary on HOPE has been based on misunderstandings about the program, and Bartels ultimately provides much-needed in-depth analysis of critiques of the HOPE model. A rigorous study which concludes by identifying key issues for jurisdictions considering implementing the model and areas for future research, this book will be of special interest to scholars of criminal justice, recidivism and drug-related issues.

Book excerpt: While historical research has noted the importance of the family in criminal justice, recent empirical work has tended to neglect the emphasis placed on the family in the criminal process. Drawing on Daly s work on familial justice, this paper investigates the role of the family in the sentencing of offenders in a specialized domestic violence court. We examine both the likelihood of incarceration and the determinants of sentence length, and find that conceptions of the family continue to have an important influence on these criminal process outcomes. In cases in which the victim has suffered serious injuries, offenders in intact relationships are more likely to be sentenced to jail, yet, at the same time, when incarcerated, these offenders receive shorter sentences. Thus, even as researchers are documenting broader shifts away from the promotion of substantive values through the criminal process, the current study suggests the continued relevance of family-based justice in the sanctioning of offenders, so that moral imperatives continue to intersect with the actuarial logic of modern penal practices.
