These are the Instrument of Government (Swedish: Regeringsformen), the Freedom of the Press Act (Swedish: Tryckfrihetsforordningen), the Fundamental Law on Freedom of Expression (Swedish: Yttrandefrihetsgrundlagen) and the Act of Succession (Swedish: Successionsordningen). Together, they constitute a basic framework that stands above other laws and regulation, and also define which agreements are themselves above normal Swedish law, but subordinate to the fundamental laws, namely the European Convention on Human Rights and several UN and EU treaties and conventions. The Parliament Act (Swedish: Riksdagsordningen) in usually considered to be halfway between a fundamental law and a normal law, with certain main chapters afforded similar protections as the fundamental laws while other additional chapters require only a simple parliamentary majority. To amend or to revise a fundamental law, the Riksdag needs to approve the changes twice in two successive terms with qualified majorities, with a general election having been held in between. The first vote can be replaced with a referendum.

It has two main aims: first to fill a gap in the literature by providing an accessible English language account of the Nordic constitutions, and second to provide a comparative analysis of them, revealing their similarities and differences within their political, historical and cultural contexts. In this respect, the book challenges the assumption that the Nordic countries form a homogeneous constitutional system due to their cultural and historical affinities, a view not necessarily supported by a close comparative examination. A key issue is EU membership –where the Nordic countries have made different choices at different times – and the book will show how this has affected the individual countries and whether a divide between EU member states (Denmark, Finland and Sweden) and non-members (Iceland and Norway) has appeared. Another key issue is how the ECHR has impacted the Nordic constitutional systems and whether the convention draws the Nordic systems closer to each other. The book represents a first of its kind in the English language, and will provide constitutional scholars with a valuable comparative resource on the Nordic region.

Book excerpt: This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. Are constitutions simply symbols of the political times at which they were adopted, or do they systematically affect the course of public policy? Are the policy crises of failing democracies the result of bad luck or of fundamental problems associated with the major and minor constitutional reforms adopted during their recent histories? The purpose of the present study is to address these questions using a blend of theory, history, and statistical analysis. The Swedish experience provides a nearly perfect laboratory in which to study the effects of constitutional reform. During the past 200 years, Swedish governance has shifted from a king-dominated system with an unelected four-chamber parliament to a bicameral legislature elected with wealth-weighted voting in 1866, and then to a new electoral system based on proportional representation and universal suffrage in 1920, and finally to a unicameral parliamentary system in 1970. All these radical reorganizations of Swedish governance were accomplished peacefully using formal amendment procedures established by previous constitutions. By focusing on constitutional issues rather than Sweden's political history, this book extends our understanding of constitutional reform and parliamentary democracy in general.
