Book excerpt: This chapter argues that the mandatory nature of the environmental integration principle has important procedural and substantive implications for the area of State aid law and policy. The requirement to integrate environmental protection requirements into all stages of state aid law and policies warrants a reconsideration of the strict effects-based approach in the analysis of environmental aid. Moreover, Article 11 TFEU obliges the European Commission to design its exemption policies in a way that promotes sustainable development and guarantees a high level of environmental protection. The current approach in the Guidelines on Environmental and Energy State Aid (EEAG) does not seem to provide adequate mechanisms for integrating environmental concerns into state aid policy when the objective of a high level of protection and improvement of the quality of the environment is taken as a benchmark. The chapter concludes by way of illustrating the significant implications of Article 11 TFEU for the nature of environmental aid granted as well as the division of supervisory powers between the Commission and the Member States.

This study looks at the existing rules and provides recommendations for the revised guidelines to effectively contribute to accelerating the decarbonisation of Europe’s economy. It calls on the European Commission to pursue a combined approach that looks at reinforcing both common objectives and specific State aid measures. Since the approval of the latest Guidelines for State Aid for Energy and Environmental Protection (EEAG) in 2014, the EU institutions have agreed to accelerate the decarbonisation process to reach a climate-neutral economy by 2050. This strong impetus heavily influences the energy market where we see new economic models and types of actors emerging, and where there has been significant technological progress over the past years. The energy and environmental protection State aid guidelines no longer reflect the market’s reality and need to be revised carefully. As Brussels is about to kick off the revision of the EEAG, this report provides recommendations for new rules that effectively contribute to fast-tracking the transition towards low carbon energy systems in a cost-efficient way. Above all, Brussels should align the new rules with its 2030 climate and energy transition targets. “The EEAG reform should combine approaches that look both at common objectives and specific aid measures. This requires a significant evolution of the current regime whilst ensuring smooth continuity. Defining clear criteria to assess the contribution of a specific State aid measure to the ‘common interest’ is of utmost importance. The revised EEAG should strengthen these assessment criteria, including for specific aid measures. They must promote technology neutrality and consider the energy system’s resilience. Among the assessment criteria, the application of the proportionality test should be improved.” - Catherine Banet, author of the report The Guidelines are part of a bigger ecosystem of rules. The EEAG work in close interaction with the general block exemption Regulation (GBER) which allows the Commission to exempt prior State aid notification – and approval – in specific cases. This has proven to be efficient and should be maintained. If, during the review, a different approach is chosen, it may impact the entire architecture of the hard and soft law ecosystem of the EU state aid regime. The Clean Energy Package for All Europeans is a driver of the reflection behind the revision of the Guidelines. The scope of application of the EEAG should reflect and build upon the provisions laid down in this package. At the same time, the new Guidelines have the challenging task of anticipating the impacts of moving climate targets from the European Green Deal and the upcoming rules to achieve them, such as the revised renewable energy directive, the revised alternative fuels infrastructure directive, the implementation of the sector integration strategy and the Hydrogen strategy. Finally, enforcing the rules is just as important as setting the right rules. The report notes that, on several occasions in its recent case law, the Court of Justice of the EU has reversed some of the European Commission’s approval decisions, with major impacts on markets. The revised Guidelines should be set and applied so as to eliminate the risk of reversals of the Commission’s decisions as much as possible. “The COVID-19 crisis is just one example of the deep uncertainties and changes our society is going through. Europe should be prepared for more disruption. We need to build a more resilient energy system that can cope with such unexpected external shocks. Book excerpt: Sustainability is based on a simple and long-recognized factual premise: Everything that humans require for their survival and well-being depends, directly or indirectly, on the natural environment. The environment provides the air we breathe, the water we drink, and the food we eat. Recognizing the importance of sustainability to its work, the U.S. Environmental Protection Agency (EPA) has been working to create programs and applications in a variety of areas to better incorporate sustainability into decision-making at the agency. To further strengthen the scientific basis for sustainability as it applies to human health and environmental protection, the EPA asked the National Research Council (NRC) to provide a framework for incorporating sustainability into the EPA's principles and decision-making. This framework, Sustainability and the U.S. EPA, provides recommendations for a sustainability approach that both incorporates and goes beyond an approach based on assessing and managing the risks posed by pollutants that has largely shaped environmental policy since the 1980s. Although risk-based methods have led to many successes and remain important tools, the report concludes that they are not adequate to address many of the complex problems that put current and future generations at risk, such as depletion of natural resources, climate change, and loss of biodiversity. Moreover, sophisticated tools are increasingly available to address cross-cutting, complex, and challenging issues that go beyond risk management. The report recommends that EPA formally adopt as its sustainability paradigm the widely used "three pillars" approach, which means considering the environmental, social, and economic impacts of an action or decision. Health should be expressly included in the "social" pillar. EPA should also articulate its vision for sustainability and develop a set of sustainability principles that would underlie all agency policies and programs.

It then explores what competitiveness and sustainable development actually mean, particularly in an EU policy context, through the lenses of Europe 2020 and the EU Sustainable Development Strategy. It concludes that not only is there a great deal of common ground between competitiveness and sustainable development, as objectives, but that increasing resource productivity is a necessary means to those shared ends. After exploring EU tax policy and the relevant rules of the UK corporation tax for evidence of any kind of focus on competitiveness and sustainable development, as well as examining the suitability of corporate income taxes as policy instruments for increasing resource productivity, the book concludes that there is ample scope for a statutory tax incentive to be appended to the UK corporation tax to help fulfil the article 3 mandate. The headline objective of the Resource Productivity Tax Credit is to promote higher resource productivity in the trading activities of individual companies, in particular targeted sectors, through improvements to the knowledge base of those companies rather than through the increased use of raw materials, non-renewable energy and/or intermediate goods.

Book excerpt: A "sustainable society," according to one definition, "is one that can persist over generations; one that is far-seeing enough, flexible enough, and wise enough not to undermine either its physical or its social system of support." As the government sector works hard to ensure sufficient fresh water, food, energy, housing, health, and education for the nation without limiting resources for the future generations, it's clear that there is no sufficient organization to deal with sustainability issues. Each federal agency appears to have a single mandate or a single area of expertise making it difficult to tackle issues such as managing the ecosystem. Key resource domains, which include water, land, energy, and nonrenewable resources, for example, are nearly-completely connected yet different agencies exist to address only one aspect of these domains. The legendary ecologist John Muir wrote in 1911 that "when we try to pick out anything by itself, we find it hitched to everything else in the Universe." Thus, in order for the nation to be successful in sustaining its resources, "linkages" will need to be built among federal, state, and local governments; nongovernmental organizations (NGOs); and the private sector. The National Research Council (NRC) was asked by several federal agencies, foundations, and the private sector to provide guidance to the federal government on issues related to sustainability linkages. The NRC assigned the task to as committee with a wide range of expertise in government, academia, and business. The committee held public fact-finding meetings to hear from agencies and stakeholder groups; examined sustainability management examples; conducted extensive literature reviews; and more to address the issue. Sustainability for the Nation: Resource Connection and Governance Linkages is the committee's report on the issue. The report includes insight into high-priority areas for governance linkages, the challenges of managing connected systems, impediments to successful government linkages, and more. The report also features examples of government linkages which include Adaptive Management on the Platte River, Philadelphia's Green Stormwater Infrastructure, and Managing Land Use in the Mojave.

Book excerpt: No Poverty, Zero Hunger, Good Health, Well-being and Quality Education – these are the first priorities of the Sustainable Development Goals (SDGs) that were launched jointly by all UN Member States on January 1, 2016. The agenda of this agreement contains 17 main goals with a total of 169 targets and is dedicated to improving global living conditions and to address issues of environmental and economical sustainability with a planning horizon through to 2030. Development assistance from economically advanced countries, also referred to as aid, is one of the major means to provide financing for countries with less developed economies that face severe social problems, and which often cannot handle these problems alone. Previous studies have shown, however, that aid is ineffective and recommend comprehensive restructuring of the common aid practices. Investigations that analyse the pattern of aid flows find, moreover, that granting aid to certain recipient countries cannot only be explained by altruistic motives. They show that several strategic or non-strategic reasons have a high explanatory power for individual donor aid allocation. Against this background, the present study explores aid effectiveness of distinct bilateral donors. This is achieved by a large-scale panel data analysis applying per-capita economic growth, infant mortality and primary growth as indicators for measuring the contribution of aid to achieving the different SDGs.
