Book excerpt: This book seeks to answer the questions: how do the rules of international treaties on trade and investment apply to the new laws and policies relating to energy-related trade, and do the rules of the multilateral system contribute to or detract from sustainable development? An emerging set of new problems in the law of international trade is how to reconcile the rules of the multilateral trading system with shortages of certain natural resources and the necessity to develop renewable energy resources. The chapters in this book provide a comprehensive analysis of the international trade issues presented by national trade laws and policies with regard to natural resources and energy. This book is about the extent to which we are interpreting existing rules to cover emerging problems and how the rules of the multilateral trading system can be adapted to achieve sustainable development in natural resources and energy. The book begins with a survey of selected national laws relating to recent restrictions on the export of natural resources, both resources used to produce energy as well as natural resources essential for industrial production. After examining the range of such laws in selected important countries, we turn to the application of the rules of the multilateral trading system to such export restrictions. We discuss the major rules of the World Trade Organization (WTO) as well as the natural resources rules in selected regional preferential free trade agreements. While there is not a comprehensive global legal regime on competition law, we believe it is also important to examine how selected national competition laws impact export restrictions on natural resources. This book will be a major contribution to the international dialogue on international economic law issues with respect to trade in natural resources and energy.

Book excerpt: "Trade is responsible for much larger amounts of material extraction than direct trade flows indicate when accounting for the additional materials, energy, water and land used in the extraction and production of traded goods but left behind as wastes and emissions in the exporting country. In 2017, the material required for trade was three times the direct trade as more than 35 billion tons of material resources were extracted globally to produce 11 billion tons of directly traded goods. This means that one-third of the total 92 billion tons of material resources extracted in the global economy that year was destined to produce goods for trade. Such analysis by the International Resource Panel of the materials embodied in trade reveals that resource-intensive processes have shifted from high-income importing countries to low-income exporting countries, with a corresponding shift in associated environmental burdens. The extraction and processing of resources for export depletes natural assets, while increasing waste, emissions, loss of biodiversity, land degradation and water pollution. Appropriate policies are therefore needed to address the adverse environmental impacts of trade and ensure that trade helps drive the transition towards a fairer, more sustainable and circular economy. Policy analysis by the United Nations Environment Programme Environment and Trade Hub shows how both multilateral trade rules and regional trade agreements can be used proactively to advance the circular economy and minimize the environmental impacts associated with resource extraction." -- Page 4 of cover

Book excerpt: The central subject of Sustainable Trade is the benefit to the global economys long-term health, derived from the proposed standardization of global trade tariffs. What we learned from the past two decades of globalization is that global efforts to tackle global problems, such as environmental degradation and resource depletion have fallen flat on their face. The Kyoto agreement, based on voluntary goodwill to make an effort to prevent climate change, has been a disaster. The free markets allocation of scarce natural resources did not prevent us from increasing our global energy thirst by 40% over two decades. The commodity price spikes we witnessed as a result in the past few years, are just a preview of what awaits us. To make matters worse, it is increasingly obvious that the owners of capital are now firmly in the driving seat when it comes to negotiating investment terms. The things they seem to put a premium on lately when it comes to allocating capital, is a lack of environmental and human rights protection and exemptions from taxation as a precondition. Given the failures we witnessed so far in trying to tackle global scale problems, which will be more frequent as we increasingly become a global village, the only logical alternative to current status quo initiatives is the sustainability trade tariff, designed to encourage environmental and human rights protections as well as encouraging efficiency evenly around the world. It is a big and even painful change that we have to make, but it may now be the only alternative to eventual collapse.

Book excerpt: This book sets out to examine one of the most important issues on trade and the environment namely, the trade effects of domestic environmental policy. The central question addressed is whether stringent domestic environmental policies reduce the international competitiveness of environmentally sensitive industries. This study is distinguished by two major innovations that go beyond the established literature: the examination of time-series evidence to explore the relationship between environmental regulations and trade patterns, and the introduction of technology factors, together with endowment factors, to explain the empirical evidence. To theoretically explore the dynamic linkage between environmental regulation, technological innovation and economic growth the author sets up an intertemporal dynamic general equilibrium model in which the more fundamental, dynamic determinant of economic growth is its capacity for technological innovation. The basic findings are that (1) changes in thestringency of environmental regulations do not have long-run growth effects; and (2) technological innovation is an important determinant of a country's long-run growth. The emphasis of this book is that the trade effects of domestic environmental policy can be better understood if one allows for a dynamic Ricardian technology factor in the conventional Heckscher-Ohlin framework. Innovation and subsequent increases in relative labour productivity, together with factor endowments, are important factors in determining the relationship between environmental regulation and international competitiveness. This result should help refocus the debate on the relationship between environmental regulationand competitiveness in international trade.

Part 2 explores how internationally traded biophysical commodities from agriculture, forestry and fisheries translates into a virtual flow of land, freshwater, and marine ecosystems. Part 3 describes how two widely used accounting tools (i.e., Life Cycle Assessment and Green National Accounts) deal with international aspects of ecosystem services, and Part 4 shows how instruments like labelling, bans, or payments for ecosystem services in the private and public sector can influence trade patterns and the management of ecosystem services. This collection is a valuable contribution to the global change science dealing with ecosystem services. It illustrates the consequences of international trade on global ecosystem services and provides an overview of accounting tools and of market-based policy instruments to address negative and positive externalities. Trade and environment is one of the most debated topics in management and economics studies over the years because of the increasing concerns on how international trade affects environment and vice versa. That said, the debate on trade and environment is not new, and it emerged in the early 1970s with concerns such as environmental protection, environmental policies on trade, and the impact on trade on environment. Most of the developed economies expressed interests on environmental degradation linked with the globalization process for instance, industrial pollution. In the 1980s, environmental concerns increased as more complex environmental issues were raised such as the climate change and the depletion of the ozone layer. Later in the 1990s, the sustainable development concept was introduced as trade liberalization and the globalization process accelerated. Several theories in support of international trade such as the economic theory has rendered the debate complex as the proponents of the economic theory argue that international trade is vital to economies because it results into a robust economic growth and also generates greater wellbeing of its citizens. That said, environmental policies and goals have been difficult to achieve during these debates. Diverse arguments exist about international trade with a few ecologists in favour of environmental protection as they argue that international trade has resulted into environmental depletion as the demand of world natural resources continue to increase. Of the two perspectives, there is an intermediate concept which has been proposed, the sustainable development which means that as international trade results into economic growth, this growth must be accompanied by environmental policies and strict environmental protection rules. Some of the defenders of sustainable development have supported free trade but with the inclusion of restrictions in multilateral negotiations so as to control the degradation of natural resources.
