The creation of the European Economic Area and near accession of the candidate Members (East European countries) has further increased the relevance of this law. This book describes EU social security law, beginning with the rules relevant to migrant workers. Coverage includes Regulations 1408/71 and 574/72 and the case law of the Court of Justice of the EC. The book analyses the contributions of these judgments to the developments of coordination law and to the realisation of the objective of free movement of workers. In this respect the relation of the Regulation and the EC Treaty, which is shown in for instance the Kohll and Decker judgments, is analysed. Special attention is paid to the Proposal for Simplification and Modernisation of Regulation 1408/71. A second main part of EU social security law is the law on equal treatment of men and women. Book excerpt: The Greek pension system has been costly, complex, and distortive, which has contributed to Greece’s fiscal problems and discouraged labor force participation. Several attempts to reform the system faltered due to lack of implementation, pushback by vested interests, and court rulings leading to reversals. A series of reforms introduced throughout 2015–17 unified benefit and contribution rules, removed several distortions and reduced fragmentation and costs. If fully implemented throughout the long-term, these reforms can go a long way towards enhancing the pension system affordability. However, reforms faced setbacks and fell short of creating stronger incentives to build long contribution histories, to deliver sustainable growth by improving the fiscal policy mix, and to ensure fairness and equitable burden sharing across generations and interest groups. Policy priorities should aim towards fully implementing the 2015–17 reforms and complementing them with additional reforms to address these remaining objectives.

The countries that are probably most concerned with the social protection for self-employed persons are the Central and Eastern European states. At the end of the twentieth century, after the fall of the Iron Curtain, they were confronted with rising entrepreneurship. Self-employed entrepreneurship was and still is one of the key elements in the transformation of their guided economy to a free market economy. The essential question for many policymakers of Central and Eastern European states is, consequently, to what extent social protection should have a place in this free economy. This publication gives an overview of the existing social security systems for self-employed people in those states in Central and Eastern Europe with which the EU has started negotiations for a possible entry. More specifically, it concerns Bulgaria, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia and Slovenia. For each state it is checked for which risks the self-employed person is socially insured and how the social security systems are structured. Moreover, the author investigates the specific problems, which the states have to deal with when developing a social security protection for the self-employed. The aim of this analysis is to present the key points in the description of the systems for self-employed persons in Central and Eastern Europe.
