Available in PDF, EPUB and Kindle. Book excerpt: With the explosion of national, international, and multinational actors becoming involved in ocean exploitation, concern has arisen over how this common resource is to be managed. One focus of these concerns has been with those international organizations already involved in ocean issues. The subject of this book is one of those international organizations, the Intergovernmental Maritime Consultative Organization (IMCO) and how it operates. The tasks and functioning of IMCO have not only been neglected by observers of international organization, but are unknown to many of those individuals specifically concerned with the operation of the1Specialized Agencies of the United Nations system.

Book Environmental Norms in Maritime Law

Download or read book Environmental Norms in Maritime Law written by Tsimplis, Michael and published by Edward Elgar Publishing. This book was released on 2021-12-07 with total page 336 pages. Available in PDF, EPUB and Kindle. Book excerpt: This timely book examines the reform of maritime law under the influence of environmental principles and the effects of these changes in the legal relationships between maritime stakeholders. Providing an integrated assessment of the use of environmental principles in the governance of shipping and maritime law, it argues that normative barriers supported by short term financial interests, the balance of power between states and the technocratic character of the IMO are delaying necessary changes to support sustainable development and thus endanger the marine environment.

Book Making Ocean Policy

Download or read book Making Ocean Policy written by Francis W. Hoole and published by Routledge. This book was released on 2019-03-12 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: Written in response to the increasing interest in the making of ocean policy, this collection of original articles surveys the history of U.S. ocean policy, ocean policy advocacy, and the struggle within government to determine how best to develop and implement a sensible ocean policy. The increasing complexity of the issues, programs, and policies related to marine and coastal zone matters and the increasing number of government agencies and interest groups formed to deal with these matters reflect the growing awareness of their importance. But, reflect the editors, in an enormously complex world, where many interests are in conflict and where information is tentative and incomplete—yet often overwhelmingly abundant—there are few easy solutions to ocean policy problems.

Book The Oxford Handbook of the Law of the Sea

Download or read book The Oxford Handbook of the Law of the Sea written by Donald R. Rothwell and published by OUP Oxford. This book was released on 2015-03-26 with total page 850 pages. Available in PDF, EPUB and Kindle. Book excerpt: Human activities have taken place in the world's oceans and seas for most of human history. With such a vast number of ways in which the oceans can be used for trade, exploited for natural resources and fishing, as well as concerns over maritime security, the legal systems regulating the rights and responsibilities of nations in their use of the world's oceans have long been a crucial part of international law. The United Nations Convention on the Law of the Sea comprehensively defined the parameters of the law of the sea in 1982, and since the Convention was concluded it has seen considerable development. This Oxford Handbook provides a comprehensive and original analysis of its current debates and controversies, both theoretical and practical. Written by over forty expert and interdisciplinary contributors, the Handbook sets out how the law of the sea has developed, and the challenges it is currently facing. The Handbook consists of forty chapters divided into six parts. First, it explains the origins and evolution of the law of the sea, with a particular focus upon the role of key publicists such as Hugo Grotius and John Selden, the gradual development of state practice, and the creation of the 1982 UN Convention. It then reviews the components which comprise the maritime domain, assessing their definition, assertion, and recognition. It also analyses the ways in which coastal states or the international community can assert control over areas of the sea, and the management and regulation of each of the maritime zones. This includes investigating the development of the mechanisms for maritime boundary delimitation, and the decisions of the International Tribunal for the Law of the Sea. The Handbook also discusses the actors and intuitions that impact on the law of the sea, considering their particular rights and interests, in particular those of state actors and the principle law of the sea institutions. Then it focuses on operational issues, investigating longstanding matters of resource management and the integrated oceans framework. This includes a discussion and assessment of the broad and increasingly influential integrated oceans management governance framework that interacts with the traditional law of the sea. It considers six distinctive regions that have been pivotal to the development of the law of the sea, before finally providing a detailed analysis of the critical contemporary issues facing the law of the sea. These include threatened species, climate change, bioprospecting, and piracy. The Handbook will be an invaluable and thought-provoking resource for scholars, students, and practitioners of the law of the sea.

Book excerpt: Analysing the regulation of vessel-source pollution from the perspective of the political interests of key players in the ship transportation industry, this 2005 book by Alan Khee-Jin Tan offers a comprehensive and convincing account of how pollution of the marine environment by ships may be better regulated and reduced. In this timely study, he traces the history of regulation at the International Maritime Organization (IMO) and investigates the political, economic and social forces influencing the IMO treaties. Also examined are the efforts of maritime states, ship-owners, cargo owners, oil companies and environmental groups to influence IMO laws and treaties. This is an important book, which uncovers the politics behind the law and offers solutions for overcoming the deficiencies in the regulatory system. It will be of great interest to professionals in the shipping industry as well as practitioners and students.

Book Navigational Restrictions within the New LOS Context

Download or read book Navigational Restrictions within the New LOS Context written by Alexander M. Lewis and published by BRILL. This book was released on 2016-12-12 with total page 230 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1986, Lewis M. Alexander, a world-renowned marine geographer, prepared for the U.S. Department of Defense a report, Navigational Restrictions within the New LOS Context: Geographical Implications for the United States. Edited by J. Ashley Roach, the reformatted report is presented in five sections and includes 20 maps, illustrating the world’s international straits and major ocean navigation routes. Forty-three tables present the most comprehensive descriptions of the world’s straits used for international navigation, as well as identify various categories of maritime claims. What made the Report extraordinarily valuable in 1986, and which makes it equally valuable today, is the compilation of geographic data - not available elsewhere - describing the world’s straits used for international navigation and illustrations of the chokepoints and major international shipping trade routes. Roach has faithfully reproduced Alexander’s seminal work by retaining the original structure and references. A table of defined terms and an index have been added.

Book Maritime Governance and Policy Making

Download or read book Maritime Governance and Policy Making written by Michael Roe and published by Springer Science & Business Media. This book was released on 2012-07-20 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: A close analysis of the framework of existing governance and the existing jurisdictional arrangements for shipping and ports reveals that while policy-making is characterized by national considerations through flags, institutional representation at all jurisdictions and the inviolability of the state, the commercial, financial, legal and operational environment of the sector is almost wholly global. This governance mismatch means that in practice the maritime industry can avoid policies which it dislikes by trading nations off against one another, while enjoying the freedoms and benefits of a globalized economy. A Post-modern interpretation of this globalized society prompts suggestions for change in maritime policy-making so that the governance of the sector better matches more closely the environment in which shipping and ports operate. Maritime Governance and Policy-Making is a controversial commentary on the record of policy-making in the maritime sector and assesses whether the reason for continued policy failure rests with the inadequate governance of the sector. Maritime Governance and Policy-Making addresses fundamental questions of governance, jurisdiction and policy and applies them to the maritime sector. This makes it of much more interest to a much wider audience – including students, researchers, government officials, and those with industrial and commercial interests in the shipping and ports areas - and also of more value as it places the specific maritime issues into their wider context. Book The Industrial Future Of The Pacific Basin

Download or read book The Industrial Future Of The Pacific Basin written by Roger Benjamin and published by Routledge. This book was released on 2019-07-11 with total page 238 pages. Available in PDF, EPUB and Kindle. Book excerpt: The consequences of changing comparative advantage are transforming the economic landscapes of nations and regions around the globe. This book deals with the most significant economic factors in the rapidly changing Pacific Basin area. Part 1 considers the area’s changing patterns of industrial development and trade and examines the general implications of such changes for national industrial development policies. Part 2 consists of a set of case studies of national industrial policies in the context of factors affecting industrial structures; how applicable these policies are to other countries in the region is a central theme. Part 3 addresses the specific issues of foreign investment and domestic labor in relation to economic growth and industrial development in the Pacific Basin. Finally, in Part 4 institutional arrangements are suggested that would facilitate economic growth while, at the same time, mitigating the serious negative consequences of changing economic advantage. Such negative consequences are to some extent pervasive and can destabilize social and political development and endanger formal and informal alliances; nevertheless, the segment of humanity that has adequate food, clothing, and shelter is being permanently widened in the Pacific Basin.

Book Nonstate Actors In International Politics

Download or read book Nonstate Actors In International Politics written by Phillip Taylor and published by Routledge. This book was released on 2019-03-01 with total page 228 pages. Available in PDF, EPUB and Kindle. Book excerpt: One of the most notable trends in the study of international relations is the resurgence of interest in international organizations, particularly those outside the United Nations. Regional international governmental organizations, multinational corporations, international labor unions, and transnational ethnic groups have become increasingly salient actors in world politics. OPEC, NATO, EEC, and PLO, for example, are all widely understood acronyms, and even a casual review of the crises in Iran and Afghanistan reveals the pervasive involvement of NATO, the European Community, the Islamic Conference, the International Olympic Committee, and more than one hundred other international governmental and nongovernmental organizations. Although international organizations are not likely to replace nation-states as the primary actors in world politics, their growing involvement in global political and economic issues challenges the assumptions of the traditionalists' state-centric model, as well as those whose interests begin and end with the United Nations. This book goes beyond the traditional UN-focused studies of nonstate actors to provide students with a comprehensive analytical survey of the many other organizations that help shape today's events. A common framework is used to examine what each nonstate actor does, how it organizes to achieve its ends, and how it makes multilateral/international decisions. The degree of integration in each nonstate actor is evaluated.
