Book excerpt: In response to a congressional request, GAO reviewed the adequacy of the Environmental Protection Agency's (EPA) system for preventing conflicts of interest among its Superfund contractors. GAO found that: (1) prior to 1988, EPA did little before contract award to determine whether its Superfund contractors had procedures to prevent conflicts of interest; (2) although EPA periodically reviewed its contractors' performance, the reviews did not routinely verify contractor compliance with EPA conflict-of-interest requirements; (3) EPA did not properly document conflict-of-interest cases, case resolutions, or actions on contractor private-party work requests in its contract files, as required; (4) EPA did not provide contractors with specific guidance for avoiding conflicts beyond its regulations and contract clauses; and (5) EPA contracting officers differed on the information they required contractors to include in their private-party work requests, due to lack of formal guidelines and definitive criteria for evaluating contractor requests.

The EPA has oversight authorities for cleaning up contaminants on federal property, and has placed 1,620 of the most contaminated sites -- including 141 DoD installations -- on its National Priorities List (NPL). As of Feb. 2009, after 10 or more years on the NPL, 11 DoD installations had not signed the required interagency agreements (IAG) to guide cleanup with EPA. This report examined: (1) the status of DoD cleanup of hazardous substances at selected installations that lacked IAGs; and (2) obstacles, if any, to cleanup at these installations. Figures. Book excerpt: This report discusses the Environmental Protection Agency's (EPA) efforts to correct long- standing contract management problems in the Superfund program. Superfund, EPA's $15 billion effort to clean up the nation's most dangerous hazardous waste sites, is one of 16 federal programs that the General Accounting Office(GAO) has identified as being most vulnerable to fraud, waste, and abuse. The program is vulnerable in part because of its extensive use of cost-reimbursable contracts, with potential values of almost $10 billion, and its history of contract management problems. The Superfund program was created by the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 to clean up the nation's most dangerous hazardous waste sites. The program has been reauthorized twice since then--first, in 1986, by the Superfund Amendments and Reauthorization Act (SARA) and again in 1990. The program's cumulative authorization is $15.2 billion. The scope and cost of Superfund have greatly exceeded initial expectations. The Superfund cleanup list, which originally included 406 sites, currently contains 1,275 sites, and EPA expects the list to grow to 2,000 sites by the year 2000. While the program has had some important accomplishments, especially in alleviating emergency conditions at sites and enforcing cleanup obligations of those who contaminated the sites, cleanups have been completed at only 90 sites. Consequently, we can expect the cleanup effort at present Superfund sites alone will run well into the next century. Superfund's authorization through 1994 will not come close to paying for EPA's projected $40 billion share of cleanup costs for the currently listed sites. (KAR) P. 2/3.

Book excerpt: Pursuant to a congressional request, GAO reviewed the Environmental Protection Agency's (EPA) response to prior GAO recommendations that EPA strengthen its management of Superfund contracts, focusing on recommendations that EPA: (1) control contractor costs; (2) set contractor indemnification and conflict-of-interest policy; and (3) develop a plan to reduce its backlog of unaudited Superfund contracts. GAO found that EPA: (1) still does not require its regional offices to prepare cost estimates of cleanup studies and as a result the regions are too dependent on the contractors' own cost proposals; (2) does require Superfund managers to review contractor invoices for reasonableness, but contracting officials in two of the four regions examined estimated that project managers were conducting invoice reviews for only about half of their contracter's invoices; (3) has not corrected the problem of excessive contractor indemnification and is still not tracking the contractors' efforts to obtain private insurance; (4) established a four-person conflict-of-interest unit to develop agency policy and guidance, but most of the previously reported problems continued to exist; (5) is developing a plan to increase contract audits and has requested increased funding to reduce a backlog, but due to proposed staffing and budget cuts, increased coverage is doubtful; and (6) has acknowledged many of the problems GAO has reported, but has not addressed them sufficiently to actually correct the problems.

Book excerpt: Pursuant to a congressional request, GAO reviewed contractor performance at 43 hazardous waste sites to determine if the Environmental Protection Agency (EPA) had established adequate controls to ensure high-quality, cost-effective, and timely work under its Superfund remedial study contracts. GAO found that EPA: (1) lacked adequate information to evaluate contractors' work plans and proposed costs; (2) did not adequately monitor contractors' expenditures; (3) did not always perform required contract administration duties, such as reviewing contractor invoices and maintaining complete work assignment files; (4) believed that inadequate contractor performance resulted in cost increases at 22 sites, but challenged cost increases at only 4 sites; (5) believed that cost challenges were difficult and time-consuming and that the contracts required it to pay for costs the contractor incurred; (6) focused on timeliness and quality of remedial studies, rather than their costs; and (7) had options for dealing with increased costs, including negotiating with the contractor to absorb costs, authorizing the increase but not a corresponding increase in the base or award fee, not authorizing the increase, terminating the contract, or disallowing the questionable cost. GAO also found that the award fee process EPA used with remedial study contractors: (1) allowed a contractor to earn the majority of an award during the first phase of the award fee process, before it completed the study and before EPA could assess its quality; and (2) contributed to overall contracting difficulties, since EPA performance evaluation criteria did not require assessment of subcontracting management.
