Book Enforcement at the EPA

Download or read book Enforcement at the EPA written by Joel A. Mintz and published by University of Texas Press. This book was released on 2012-04-01 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: The only published work that treats the historical evolution of EPA enforcement, this book provides a candid inside glimpse of a crucial aspect of the work of an important federal agency. Based on 190 personal interviews with present and former enforcement officials at EPA, the U.S. Department of Justice, and key congressional staff members—along with extensive research among EPA documents and secondary sources—the book vividly recounts the often tumultuous history of EPA’s enforcement program. It also analyzes some important questions regarding EPA’s institutional relationships and the Agency’s working environment. This revised and updated edition adds substantial new chapters examining EPA enforcement during the Clinton and George W. Bush administrations. Its treatment of issues of civil service decline and the applicability of captive agency theory is also new and original.

Book Superfund

Download or read book Superfund written by John B. Stephenson and published by DIANE Publishing. This book was released on 2009-02 with total page 33 pages. Available in PDF, EPUB and Kindle. Book excerpt: One in four Americans lives within 3 miles of a hazardous waste site (HWS). To clean up the highly contaminated sites, the Congress established the Superfund program in 1980. EPA has identified more than 47,000 HWS potentially requiring cleanup actions and has placed more than 1,500 of the most seriously contaminated sites on its National Priorities List (NPL). Cleanup efforts at NPL sites are expensive and can take many years. To fund program activities, a trust fund was financed by taxes on crude oil and certain chemicals, as well as an environ. tax assessed on corp. This report examines the: (1) sources of funding for the Superfund trust fund; and (2) allocation of these resources to Superfund program activities. Illustrations.

Book Cleaning Up the Mess

Download or read book Cleaning Up the Mess written by Thomas W. Church and published by Brookings Institution Press. This book was released on 2001-05-16 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: The federal Superfund program for cleaning up America's inactive toxic waste sites is noteworthy not only for its enormous cost - $15.2 billion has been authorized thus far - but also for its unique design. The legislation that created Superfund provided the Environmental Protection Agency with a diverse set of policy tools. Preeminent among them is a civil liability scheme that imposes responsibility for multimillion dollar cleanups on businesses and government units linked - even tangentially - to hazardous waste sites. Armed with this potent policy implement, the agency can order the parties who are legally responsible for the toxic substances at a site to clean it up, with large fines and damages for failure to comply. EPA can also offer conciliatory measures to bring about voluntary, privately financed cleanup; or it can launch a cleanup initially paid for by Superfund and later force the responsible parties to reimburse the government. In this book, Thomas W. Church and Robert T. Nakamura provide the first in-depth study of Superfund operations at hazardous waste sites. They examine six Superfund cleanups, including three regions and both 'hard' and 'easy' sites, to ask 'what works?' Based on detailed case studies, the book describes various strategies that have been applied by government regulators and lawyers and the responses to those different strategies by businesses and local government officials. The authors characterize the implementation strategies used by the EPA as prosecution, accommodation, and public works. They point out that the choice of strategy involves setting priorities among Superfund's competing objectives. They conclude that the best implementation strategy is one that considers the context of each site and the particular priorities in each case. Looking toward the reauthorization of Superfund, they also offer recommendations for improvements in the organization of the program and discuss proposals for change in its

Book Environmental Enforcement

Download or read book Environmental Enforcement written by Joel A. Mintz and published by . This book was released on 2007 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: This casebook is now availabe in paperback. To view the 2012 update supplement, click here. Environmental Enforcement is the first casebook devoted exclusively to environmental enforcement issues. Perfect for a specialized course or seminar, or as a supplement to existing survey courses, the book provides in-depth coverage of this emerging and dynamic field. Although literally thousands of attorneys in government, private practice, and public interest organizations are involved in environmental enforcement in all or nearly all of their practice, this subject too often receives only cursory treatment in traditional texts. This book introduces future lawyers to the full range of legal issues and practical challenges they will face when handling environmental enforcement cases. The book begins with an examination of the theories underlying the various models of environmental enforcement and the appropriate roles of the federal and state governments in enforcement. It then contains chapters on government investigative authorities and administrative, civil, criminal, and citizen enforcement. There also is a lengthy chapter devoted to the specialized issues arising in Superfund enforcement. The book then examines the burgeoning area of compliance incentives and assistance programs, and also discusses alternative enforcement strategies, such as permit bars, public spotlighting techniques, and common law theories. Problem exercises appear throughout the book.
