Book excerpt: Excerpt from Summary of Cooperative Cases, Vol. 14: September 1960 The court asserted that an examination of section 807 of the Milk Control Law revealed that the legislature took unusual care to make it clear that all methods to circumvent the minimum price fixed for the sale of milk and to regulate milk products were illegal. The court concluded that the device used to return a part of the purchase price to the merchants resulted in sales of approximately $boo,000 per year by appellant, undoubtedly business taken from other dealers who were charging the minimum price established by the Commission, and it held that the contractbetween Shearer and Frankford was a device to Circumvent the price established by the Milk Control Commission in violation of sec tion 807, supra. Of the Milk Control Law. Accordingly, the court affirmed the order suspending the license of Shearer's Dairies, Inc. In other words, all purchasers of glucose paid a flat price and in addition an amount equal to the freight on the purchase from Chicago to the point of delivery even though the shipment might be made from the factory of the defendants in.kansas City. Purchases of glucose might be made from the factory in Chicago and deliv ery accepted there, and thus the purchasers would be relieved from the payment of any freight charges on the purchases. Ih some instances the freight from Kansas City on a shipment to the point of delivery would exceed the amount of freight on a comparable shipment that might be made from Chicago. In instances of this kind the defendants absorbed the difference.
