Book excerpt: This work brings together the papers presented at a conference on `New Dimensions of Peacekeeping' which was convened at the Graduate Institute of International Studies in Geneva in March 1994. The papers address the new role of peacekeeping (including peacekeeping and peace enforcement) which is now emerging and also places an emphasis upon the role of the `newcomers' in peacekeeping, specifically Japan and Germany. The collection of papers, by many distinguished scholars in the field, actively discusses both the strengths and weaknesses of the United Nations peacekeeping efforts in meeting the increasing demands placed upon it due to the enormous upsurge in ethnic, religious and other local conflicts. `The 1990s have seen wide swings in public opinion towards United Nations Peacekeeping. The euphoria and high expectations regarding what the United Nations can deliver have been replaced by the rude shocks and deflated assessments of its capacity to successfully cope with conflicts. In this context, it would be highly desirable that a judicious balance be struck in the evaluation of United Nations peacekeeping activities, which takes fully into account the great potential they have for contributing to international peace and security and to the reduction of human suffering. At the same time, such a review should include a candid discussion regarding the weaknesses and shortcomings of peacekeeping activities.' In addition, international and regional organizations have also performed peacekeeping functions. Since the establishment of the first UN peacekeeping mission, UNEF I, in 1956, international lawyers have raised questions about the legal aspects of these operations. Traditionally, they analyzed the constitutional basis for peacekeeping and tried to allocate the authority under the UN Charter for peacekeeping among the Security Council, the General Assembly and the Secretary General. They discussed the use of force by peacekeepers, the applicability of international humanitarian law, as well as the responsibilities and liabilities of peacekeepers. Since the end of the cold war, peacekeeping operations have become more complex. In the first forty years, peacekeepers functioned mainly as buffer zones between warring parties and monitored cease-fires. Nowadays, they are increasingly engaged in internal rather than international conflicts and perform a multitude of tasks. Among others, they act as civilian administrators, oversee elections and monitor human rights. These changes have raised new legal problems. Which human rights obligations exist for peacekeepers? Do peacekeepers have to intervene if they witness war crimes and acts of genocide? How are they protected under international law? What is the legal framework of UN administrations like in Kosovo and East Timor? In order to enhance a better understanding of these legal issues arising from peacekeeping operations, a collection of articles written by the leading experts in the field have been compiled in the volume, International Peacekeeping.

Book excerpt: One of the most vexing issues that has faced the international community since the end of the Cold War has been the use of force by the United Nations peacekeeping forces. UN intervention in civil wars, as in Somalia, Bosnia and Herzegovina, and Rwanda, has thrown into stark relief the difficulty of peacekeepers operating in situations where consent to their presence and activities is fragile or incomplete and where there is little peace to keep. Complex questions arise in these circumstances. When and how should peacekeepers use force to protect themselves, to protect their mission, or, most troublingly, to ensure compliance by recalcitrant parties with peace accords? Is a peace enforcement role for peacekeepers possible or is this simply war by another name? Is there a grey zone between peacekeeping and peace enforcement? Trevor Findlay reveals the history of the use of force by UN peacekeepers from Sinai in the 1950s to Haiti in the 1990s. He untangles the arguments about the use of force in peace operations and sets these within the broader context of military doctrine and practice. Drawing on these insights the author examines proposals for future conduct of UN operations, including the formulation of UN peacekeeping doctrine and the establishment of a UN rapid reaction force.

In this study, Charles Asante argues that the significance and continuity of Nkrumah’s legacy is often attributed to his pan-Africanist leadership on the African continent, fervently articulating an independent African foreign policy. Leaders like Nkrumah, considered themselves as the redeemers of Africa’s political and economic vulnerability from its colonial experiences. Asante finds that, in contrast to the positive experience associated with his independence movement for Ghana, Nkrumah could not build the same kind of vision, engagement, and networks among other African nationalist leaders necessary for successful promotion of a Pan-African region. Despite Nkrumah’s own foreign policy failures in the Congo, the United States of Africa project, and his sudden overthrow in 1966, Nkrumah’s Pan-African vision is still promoted as an important foreign policy objective by Ghana’s politicians, public servants, military, and academics.

Book excerpt: A fresh examination of the origins, evolution and future of proposals for a UN 'Legion' - a permanent military force recruited, trained and deployed by the UN. This new book shows how this idea has grown, re-emerged and evolved in direct connection with the development of UN international military forces. The legionnaires have been seen as the future representatives of a modern constabulary, international police or humanitarian chivalry. They have also invariably evoked the idea of mercenaries and resurrected fears of supranational government and a 'world army'. Such a force has been unattainable when needed, not needed when attainable, revealing the deficiencies of the international system in the perspective of a particular task. The idea highlights the inadequacy of the means as compared to the objectives, and the limits of the UN's capacity to adapt itself to new challenges. This study examinmes how the project of a UN 'Legion' is conditional on the viability of the original Utopia, and vice versa. It also argues that the extreme polarization of the debate may reflect a tendency to negate the inherent contradictions of reality, reminding us of the historical dimension of the building of an international organization, a 'work in progress'.
