Book excerpt: Excerpt from The Railroad Problem: Comments on Certain Methods, Suggested for Solving It In the discussion of the Railroad Problem now before Congress, it seems safe to assume that the following propositions are too clear to require or admit of argument: 1. That it is necessary for Congress to enact, at the earliest date practicable, legislation required to develop and continue to provide the railroad facilities which the country must have. 2. That the country has definitely made up its judgment against the ownership and operation of the railroads by the Government. 3. That public opinion overwhelmingly favors the continuance, by private ownership, of competition in service and facilities furnished by railroad carriers. It will be assumed, therefore, that these propositions are established, and they will not be discussed. Plans for solution of the problem have been presented in such number, and discussion has taken such wide range, that Congress must be confused by the multitude of suggestions. Probably every theory of railroad regulation has been presented; and many of these theories, while plausible and attractive in the abstract, are impracticable when applied to actual conditions. Of all the great current social and economic questions, it is doubtful whether any domestic problem is as significant or far-reaching, from the standpoint of the general welfare, as the problem of the railroads. Not only is every citizen vitally concerned in its satisfactory adjustment, but the degree of success which crowns the joint efforts of private enterprise and government activity in its solution will constitute the most convincing test of the efficacy of our democratic institutions in meeting the dominant tasks of this generation. At every point, therefore, the essential issues must be conceived in terms of their public bearing, and each measure designed to adjust conflicting claims must be assessed with reference to the common good. A great complexity of interests is involved. The worst evil of modern academic life, particularly under the elective system, is that the student may so seldom be called upon to think for himself; - not merely to "cram" and memorize, to absorb information predigested by an instructor, but rather to actively use his reasoning powers in effecting recombinations of ideas. Mere passive contact for a brief period of life with cultivating influences and high ideals, as exemplified in books, general environment, and, it is to be hoped, instructors of the right sort, tends to produce the dilettante, unless at the same time the mind is constantly invigorated by action. This is especially true of the economic and social sciences. To provide material, preferably of a debatable sort, which may be worked over under discussion in the class room, instead of being merely committed to memory, constitutes the pedagogical aim of this book. Some of the extracts, especially the historical ones, are of course not susceptible of such treatment. They are merely reference readings for convenient use. But the others, notably the decisions of the Interstate Commerce Commission, usually provide debatable matter of an admirable sort. This is peculiarly true of cases or decisions with a dissenting minority opinion. Another advantages which many of these economic cases possess, over proposition in mathematics, logic, or even laws, as material for training the intelligence, is that they are always charged with human, and often with great public, interest and that they incidentally involve an acquaintance with the underlying business condition and trade of the country at large. All of this is now changed. A silent revolution has taken place in the minds of men. Competition is recognized as im possible. Accordingly the Railroad Act of 1920 authorizes pooling, and the leasing of one railroad to another,3 and the purchase by one railroad of the stock of another.' It author izes the consolidation of railroad systems and goes farther and directs the Commission to formulate a plan for consolidating all the railroads of the country into a few systems.6 The Act of 1920 authorizes, with the consent of the Commission, the acquisition of one railroad by another, by lease or stock con trol or in any other manner, except by consolidation. Even consolidation is authorized, but competition shall be preserved as fully as possible. That preservation of competition is feeble indeed. Then there is another fundamental departure in the Act of 1920, namely, that the Commission shall make railroad rates high enough to pay at least on the value of the railroads for two years at least. This approaches real public control and the elimination of private control. The government is being swept by the cur rent of events into greater and more absolute control.
