Book excerpt: In recent times, the spotlight of international media attention has often focused on problems which have their roots in the inequitable distribution of agricultural land - still a characteristic of many developing countries. For example, media coverage of the social unrest that has beset Zimbabwe since the closing years of the twentieth century has been relentless. Large plantations still exist in the Caribbean - a legacy of the erstwhile economic importance of sugar to the region. However, on several islands, the traditionally highly skewed pattern of land distribution has been successfully reformed - in most cases without recourse to violence and confiscation in a revolutionary context. In St. Vincent, the demise of the plantation and the emergence of an independent peasantry are attributable, to a significant degree, to public policy formulated and implemented over a period of one hundred years. Karl John's study chronicles the historical course of these official interventions aimed at reforming the land tenure structure in this small island developing state. The work pays particular attention to the motives for the policies and strategies adopted for land reform, critically evaluates the planning and implementation of related programs and projects, and assesses the role of prevailing economic, social and political forces in both limiting and enabling their success.

Most of the rural poor remain dependent on land-based livelihoods for their incomes and reproduction despite significant livelihood diversification in recent years. Land issue remains critical to any development discourse today. Market-led agrarian reform (MLAR) has gained prominence since the early 1990s as an alternative to state-led land reforms. This neoliberal policy is based on the inversion of what its proponents see as the features of earlier approaches, and calls for redistribution via privatized, decentralized transactions between ‘willing sellers’ and ‘willing buyers’. Its proponents, especially those associated with the World Bank, have claimed success where the policy has been implemented, but such claims have been contested by independent scholars as well as by peasant movements who are struggling to gain access to land. This book presents three thematic papers and six country studies. The thematic papers address issues of formalisation of property rights, gendered land rights, and neoliberal enclosure. These studies demonstrate the pervasive influence of neoliberal ideas on property rights and rural development debates, well beyond the ‘core’ question of land redistribution. The country cases bring together experiences from Brazil, Guatemala, El Salvador, Philippines, South Africa and Egypt. Common findings include the success of landowners in minimising the impact of reform, and a lack of post-transfer support, translating into marginal impact on poverty. The limitations of the market-led approach, and the implications of the studies presented here for the future of agrarian reform, are considered in the editors’ introduction. This book was a special issue of The Third World Quarterly.

It examines the implications for land law reform in the broadening of development goals beyond growth to include environmental protection, poverty eradication, and achievement of gender equity, and it reviews a broad range of experience in land law reform. After the introductory chapter, chapter 2 examines how land law reform is achieved through World Bank initiatives. It reviews steps the Bank has taken to achieve comprehensive reforms of land law in the context of natural resource management and land reform programs and land administration projects. It also analyzes lessons learned from various land law reform processes. Chapter 3 addresses reform of rules affecting women's access to and rights in land. The topic is one in which broad recommendations are not necessarily easy due to cultural and other norms governing women's rights and freedoms regarding land. Chapter 4 examines how to develop land markets while minimizing adverse effects and enhancing positive impacts on the poor. Chapter 5 discusses the importance of titling and registration of land rights, reviews concepts that are supported by the Bank in many of its land projects, and describes how titling and registration can affect economic growth and the alleviation of poverty. Chapter 7 deals with issues of equity and poverty in the context of conservation and environmental protection of farms and forests. It examines the role of individual property rights, as well as the legal tools that can be used to encourage conservation. Book excerpt: The recent land tenure reforms in Rwanda have the potential to permanently influence the debate around land titling and clear property rights. In 2005, when Rwanda decided to abandon traditional property rights and to embrace formal rights, least did it know it would transform itself by moving from no land records to one of the most advanced and formalized land records in less than two decades. Rwanda climbed to 2nd rank in 2018 in World Bank’s ranking of ‘Ease of Registering Property’ from 137th rank in 2008. Rwanda created its cadastre at a reasonably low cost and in a relatively shorter time period as it adopted the ‘general boundaries’ or visible boundaries such as road, fence, or hedge over more accurate ‘fixed boundaries’. International agencies recommended Rwanda’s approach in the form of implementation guidelines to other developing countries within a theoretical framework FitforPurpose (FFP) land Administration. According to the recommended guidelines, the developing countries should adopt FFP as their initial goal, and thereafter, they may aim for an ‘ultimate solution’ one that developed countries have adopted. This view presents FFP as a cheaper and low-tech solution but also sub-par as compared to the standards adopted by developed countries. This thesis questions the correctness of perception of FFP being sub-par. However, Rwanda still faces informal transactions despite the high rank in ‘ease of registering property’ and the 6th lowest transaction fee in the world. This study explores the question “ Is it ever possible (or efficient enough) to completely formalise all property transactions?” The thesis presents voluntary titling as a middle ground between the binary debate ‘in favour of’ or ‘against’ land titling. It also attempts to analyse the land tenure reforms in Rwanda to deduce the important learnings for implementation of titling projects elsewhere.

The comparative perspective of this book clarifies new features of African social changes, which are carefully investigated by area experts. Providing new perspectives on recent land reform, this book will have a considerable impact on scholars as well as policymakers.
