Nor has it nurtured a new generation of farmers. [...] A Critical Assessment l 5 While some advocates regard the ALR as sacrosanct, it is entirely rea- sonable for citizens to question the legitimacy of a regime by which the gov- ernment deprives property owners of the use of their land-and the public of the tremendous benefits of markets-in order to indulge special inter- est groups that expect the general populace to shoulder the costs of their pref [...] The central conceit of land control schemes like the ALR is the notion that the government is better equipped than the transformative powers of markets to supply the public with both necessities, such as food, and ameni- ties, such as "green space." But there is abundant evidence to the contrary. [...] While some ALR advocates will object, it is incumbent upon citizens to ques- tion the legitimacy of a system by which the government deprives property owners of the free use of their land-and the public of the tremendous ben- efits of markets-in order to indulge special interest groups who favor hay fields over houses and expect the general populace to shoulder the costs of their preferences. [...] A Critical Assessment l 9 The establishment of the Agricultural Land Reserve In the 1960s, concerns emerged in Canada, and elsewhere, about the conver- sion of farmland for development.

[...] The purpose is to preserve the ability of the land and the farm community in the ALR to produce food. [...] Even the provincial government must conduct itself according to the Act.24 Section 18 of the Act demonstrates the scope of the Commission's mandate to regulate the use of ALR land: it states that other levels of government must not permit non-farm uses of ALR land unless permitted by the Act, regulations, or terms imposed by an order of the Commission. [...] Section 6 of the Act sets out the most current wording of the mandate of the Commission:29 Purposes of the commission 6 The following are the purposes of the commission: (a) to preserve agricultural land; (b) to encourage farming on agricultural land in collaboration with other communities of interest; (c) to encourage local governments, first nations, the government and its agents to enable and a [...] It is the soil/climate suitability of the land and not the present economic viability of farming the land that is the essence of the phrase.30 The Act does not provide any additional criteria or direction as to the purposes of the Commission and the decision-making approach that the Commission should take on applications to it.

Book excerpt: There is concern that agricultural land use planning in British Columbia (BC) has become too focused upon and driven by the Agricultural Land Commission's (ALC) application process. According to Richard Bullock, former Chair of the ALC, too much prominence has been given to the application process and not enough to long-range planning. Given the importance of Bullock's statement and the potentially significant implications, it is critical to further investigate Bullock's assertions. Therefore, the purpose of this research is to analyze Bullock's statement and assess whether the ALC is driven by the application process and the extent to which it supports or undermines long-range agricultural land use planning. Data were collected through a content analysis of ALC application archives, Agricultural Advisory Council (AAC) meeting minutes for the City of Kelowna, and key informant interviews with planning professionals. Results reveal that Bullock's statement is valid, but only to a limited extent because the application process does not hinder long-range planning for farmland protection in BC the current legislative framework hinders it. The results of this study expose how the effects of a few legislative details have had the double effect of increasing the prominence of applications and constraining what long-range planning that the ALC can do. --Leaf 2.
