Book Structured Settlements and Interim and Provisional Damages

Download or read book Structured Settlements and Interim and Provisional Damages written by Great Britain. Law Commission and published by Stationery Office Books (TSO). This book was released on 1992 with total page 102 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Law Commission has not examined the subject of personal injury litigation for some years. Much has happened since then. This consultation paper arises from the Law Commission's current examination of the principles governing and the effectiveness of the present remedy of damages for monetary and non-monetary loss. It addresses aspects of the question of whether the damages remedy is effective, and how it can be made more effective. It canvasses the deficiencies of lump sum damages, and considers whether the development of voluntary structured settlements, and the existing provisions for interim and provisional payments, usefully correct such deficiencies.

Book Court ordered Structured Settlements for Personal Injury Damage Awards

Download or read book Court ordered Structured Settlements for Personal Injury Damage Awards written by Law Reform Commission of Nova Scotia and published by . This book was released on 2004 with total page 19 pages. Available in PDF, EPUB and Kindle. Book excerpt: Structured settlements can arise in personal injury cases where damages are awarded. A structured settlement is a method of paying a claimant their damages in whole or in part by means of periodic payments rather than a one-time lump sum. This paper is concerned with the relatively narrow question of in what circumstances should the Nova Scotia courts exercise a power to order a structured settlement. It first presents some definitions of terms and a review of some of the salient features of lump-sum settlements in contrast to those of structured settlements. It then reviews the use of structured settlements in British Columbia, Manitoba, & Ontario. Finally, it notes some relevant considerations regarding how the courts have acted in imposing structured settlement orders.

Available in PDF, EPUB and Kindle. Book excerpt: NEW in paperback From the Reviews of the hardback edition: This is a fascinating and thought-provoking collection of eight essays..... Taken together they represent a coherent and compelling exposition of the English law of obligations.... One is left with the picture of an [author] ... who remains a devotee of "practical scholarship" and the deductive technique of the common law and has a grasp on its intricacies second to non." Edwin Peel, The Law Quarterly Review, 1999 "[These essays], all concerned with various aspects of contract, tort and unjust enrichment, are a pleasure to peruse, and a distinct cut above the usual lacklustre collection of past triumphs now beyond their sell-by date. Without exception they are both topical and relevant: ... together they form a readable, scholarly and eclectic mixture of exposition and polemic, of speculation and analysis" Andrew Tettenborn, The Cambridge Law Journal, 1999 "..quite simply the most convincing and complete explanation of the law of obligations that is currently available - the book is thorough, compelling, definitive, and highly important." Paul Kearns, Anglo-American Law Review, 1999 "an extremely important work, produced by a leading academic." David Wright, Adelaide Law Review
