GAO noted that: (1) the cost and scope of Superfund have greatly exceeded initial projections of $1.6 billion for the cleanup of 406 hazardous waste sites in 1980 to $40 billion for 1,275 sites, with a projected increase of 700 sites needing attention by 2000; (2) the program has taken more than 2,800 emergency actions, sometimes at non-Superfund sites, to address immediate, serious site threats; (3) EPA has improved its enforcement of laws to make responsible parties clean up contaminated sites or pay for government-funded cleanups; (4) administrative and support costs account for 41 percent of Superfund appropriations; (5) Superfund contract management controls and oversight do not adequately provide for cost control, contractor review, or protection against program abuses and waste; (6) the pace of Superfund cleanups is sluggish due to the lengthy site study and remedy evaluation process; (7) with increased emphasis on faster and more cost-efficient cleanups, EPA will need to ensure the effectiveness and integrity of site cleanups; and (8) the lack of solid information on the health and environmental dangers posed by Superfund sites makes it difficult to assess the risks and determine the most effective use of the scarce resources available for environmental protection.

EPA can also conduct cleanups itself and then seek reimbursement. EPA is authorized to retain and use funds received from settlements with these parties in interest-earning, site-specific special accounts within the Trust Fund. These accounts provide resources in addition to annual appropriations to clean up sites. The number of accounts grew slowly until 1995 when EPA encouraged their greater use. After 1995, their number and dollar value increased. EPA headquarters is responsible for overseeing its regions' management of special accounts. In two reports issued in 2006 and 2009, the EPA IG made recommendations to EPA to better manage these accounts.As requested, this report examines the (1) status-that is, balances, locations, and recent and planned uses-of Superfund special accounts, and (2) extent to which EPA's headquarters and regions have implemented processes and policies to improve the monitoring and management of these accounts. Book excerpt: Across the United States, thousands of hazardous waste sites are contaminated with chemicals that prevent the underlying groundwater from meeting drinking water standards. These include Superfund sites and other facilities that handle and dispose of hazardous waste, active and inactive dry cleaners, and leaking underground storage tanks; many are at federal facilities such as military installations. While many sites have been closed over the past 30 years through cleanup programs run by the U.S. Department of Defense, the U.S. EPA, and other state and federal agencies, the remaining caseload is much more difficult to address because the nature of the contamination and subsurface conditions make it difficult to achieve drinking water standards in the affected groundwater. Alternatives for Managing the Nation's Complex Contaminated Groundwater Sites estimates that at least 126,000 sites across the U.S. still have contaminated groundwater, and their closure is expected to cost at least $110 billion to $127 billion. About 10 percent of these sites are considered "complex," meaning restoration is unlikely to be achieved in the next 50 to 100 years due to technological limitations. At sites where contaminant concentrations have plateaued at levels above cleanup goals despite active efforts, the report recommends evaluating whether the sites should transition to long-term management, where risks would be monitored and harmful exposures prevented, but at reduced costs.

We are making recommendations to the Administrator of EPA designed to improve the agency's information on and management of cleanups of high-risk sites, maximize EPA'S recovery of cleanup costs, and help prevent EPA from incurring unnecessary costs for contractors' work. The magnitude of the nation's hazardous waste problem calls for making effective use of limited available funds. Current estimates indicate that cleanups are expected to cost the federal government about $300 billion and the private sector hundreds of billions more. Since the early 1990s, GAO has identified several long-standing management problems with the Environmental Protection Agency's (EPA) Superfund program, created under the Comprehensive Environmental Response, Compensation, and liability Act of 1980. These problems have hindered the agency's ability to effectively manage cleanups of the nation's most hazardous sites. This report assesses (1) the efforts that EPA and the other federal agencies with major cleanup responsibilities have made to set priorities for spending limited cleanup funds at the sites posing the highest risks, (2) EPA'S actions to recover its expenditures for cleanups from the parties that are legally liable for the contamination, and (3) EPA'S efforts to better control contractors' cleanup costs.
