The deep feuds among the Empire, the Churches unified by Roman papacy and the flourishing cities gave rise to very new legal ideas with the strong cooperation of the universities, beginning with that of Bologna. The teaching of Roman law and of the new papal laws, which quickly spread all over Europe, built up a professional group of lawyers and notaries which shaped the new, 'modern', public institutions, including efficient courts (like the Inquisition). Politically divided, Italy was partly unified by the legal system, so-called (Continental) common law (ius commune), which became a pattern for all of Europe onwards. Early modern Europe had for long time to work with it, and parts of it are still alive as a common cultural heritage behind a new European law system.

This principle was the basis for the compilation of the so-called Pre-Gratian canon law collections, too. In the recent research, there have arisen new stresses on the better understanding of how this textual development of canonical collections had happened prior the Decretum Gratiani. An original canonical textual witness testifies about the circumstances of its origin, and, indeed, about the physical effects on the text during daily usage. The endeavor to issue the complete canon law did not mean only the composition of the universal canonical norms, but also the gathering of the particular norms, inveterate customs, or theological statements that could set the contents of the ecclesiastical discipline in the proper light.

The variety of authorial nationalities gives the collection a multicultural character and the breadth of the chronological period it deals with from antiquity to the contemporary age adds further depth of insight.As the element that unites the collection is historiographical interpretation, we wanted to bring to the fore its historical depth. Thus for every chapter we organized the articles in chronological order according to the historical context covered.Looking at the final outcome, it was interesting to learn that more often than not the connection between law and humanities is not simply a relation between a specific branch of the law and a single field of the humanities, but rather a relation that could be developed in many directions at once, involving different fields of knowledge, and of arts and popular culture.We are grateful to Luigi Lacchè for his contribution to this collection. Book excerpt: This work offers a detailed reconstruction of the campaigns for and trials resulting in the beatification (in 1626) and subsequent canonization in 1169 of the Florentine mystic nun, Maria Maddalena de' Pazzi (1566-1607). Clare Copeland places her findings in the wide context of the politics of saint-making at a time of particular significance for the history of Roman Catholic canonization. The Protestant Reformation had put the Roman Catholic Church on the defensive in this area of devotional practice and the period covered in this volume (ca. 1600-1669) saw far-reaching reforms in the ways in which sanctity was measured and adjudicated by Rome. Copeland shows how these developments need to be seen less in terms of a top-down attempt by the central organs of ecclesiastical control to impose a hegemony of holiness and more in terms of negotiation over the meanings of sanctity—and how it relates to canonization-between the various stakeholders.

Popes Benedict XV (1914-1922), Pius XI (1922-1939), and Pius XII (1939-1958) faced the challenges of two world wars and the Cold War, and threats posed by totalitarian dictatorships like Italian Fascism, German National Socialism, and Communism in Russia and China. The wars imposed enormous strains upon the unity of Catholics and the hostility of the totalitarian regimes to Catholicism lead to the Church facing persecution and martyrdom on a scale similar to that experienced under the Roman Empire and following the French Revolution. At the same time, these were years of growth, development, and success for the papacy. Benedict healed the wounds left by the 'modernist' witch hunt of his predecessor and re-established the papacy as an influence in international affairs through his peace diplomacy during the First World War. Pius XI resolved the 'Roman Question' with Italy and put papal finances on a sounder footing. He also helped reconcile the Catholic Church and science by establishing the Pontifical Academy of Sciences and took the first steps to move the Church away from entrenched anti-Semitism. Pius XI continued his predecessor's policy of the 'indigenisation' of the missionary churches in preparation for de-colonisation. Pius XII fully embraced the media and other means of publicity, and with his infallible promulgation of the Assumption in 1950, he took papal absolutism and centralism to such heights that he has been called the 'last real pope'. Ironically, he also prepared the way for the Second Vatican Council.
