Book excerpt: Excerpt from Statute Law Making in the United States Since law is becoming so important a factor in shaping the economic and social conditions under which we live, it is essential that the making of statutes should receive greater attention. In, no other great country of the world is the passage of new statutes and the change of old ones so easy as in the United States. The amount of legislation increases year by year, the laws touch us more and more intimately in our daily lives. Under such conditions it seems that it would be only natural that great care would be taken in the framing of statutes. Those who drafted measures we might believe would be sure to see to it that rights not intended to be affected were not touched, that what the bill was intended to accomplish was done in the easiest way and that the law should not offend constitutional provisions. But the fact is quite the contrary. Our love of freedom of initiative has extended to legislation. Bills are introduced in such numbers that it is impossible for them to receive adequate consideration. They are often drafted by men who have not made any attempt to see the proposed measures in the perspective of the general law of the state. As a consequence we have a mass of ill-considered statutes which, by their indefiniteness and failure to observe constitutional limitations, throw upon the courts a burden of interpretation which forces them frequently to resort to judicial legislation and to declare the statutes void. It is by and through these law making bodies women must establish their protective and defensive measures and these measures should be so fair, sane and equitable as to command universal respect and confidence. Careful and intelligent progress by women in the shaping of such new laws as are intended to equalize their status with the male citizen will best demonstrate their right to citizenship with its resultant obligations and duties, for in the multiplicity of laws now cluttering our statute books a few more, unless direct, forceful and valid, will but add to the confusion and defeat their purpose. It may be well to recall the fact that in 1913 more than two thousand bills were introduced in the Wisconsin legislature, of which eight hundred and twenty three were passed. The law making bodies of other States stagger, session after session, under equally heavy burdens. Wherefore it would seem that a Bureau of Legislation, with women fairly represented, to which all bills would have to be submitted for approval before introduction. In making the selections, I have endeavored to cite such cases as are actual adjudications on the statute, or plainly illustrate some principle of law directly connected therewith. Book excerpt: Excerpt from Introduction to American Law But I have entitled this book, an Introduction to American Law, and I may be called upon to vindicate the propriety of this title. I confess then, that in some minor respects, it may not be equally adapted to all parts of the Union; but my excuse is, that without being ten times as large as it is, 'it could not have been made so. If I had possessed the knowledge, I could not, within any reasonable compass, have referred to the local law of twenty-six different states; and yet local references were occasionally necessary, in order to exhibit an entire system. I was compelled, therefore, in such cases, to make choice of some particular state; and I naturally selected that state in which the lectures were read. But these local references, in an out line so general as this, are not so frequent as to detract materially from the general adaptation of the book, to students in other states; and in case of diversity, the necessary corrections can be easily made. At all events, the diversity is less between the different states, than between any one state and England; and therefore something is cer tainly gained even on the score of general adaptation. And here let me anticipate an objection of another sort. It may be said, that in attempting to teach what the law is, I have dwelt too much upon what I think it should be; or, in other words, that in a work professedly didactic, I have speculated too much upon projects of reform. To this objection I have two answers. In the first place, I have never undertaken to show what the law ought to be, without first stating what it is. While therefore the primary end of instruo tion is obtained, the mind of the student is at the same time excited to compare, examine and discuss the principles in question; and thus impress them the more deeply upon his memory. And in the second place, if the suggestions I have ventured to make be sound, they can not be made too early, because bad laws are the very worst of bad things; and if these suggestions be not sound, they can do no harm, because the antidote accompanies the bane; nay the provision com plained of will inspire increased confidence in the mind of the student from having been unsuccessfully assailed.
