Book excerpt: To meet long-standing concerns about the Department of Defense's (DOD) organization and management of national security space activities, Congress chartered the Commission to Assess United States National Security Space Management and Organization to study the organization and management of space activities that support U.S. national security interests and make recommendations for improvements. DOD has decided to take actions related to 10 of the commission's 13 recommendations. These include recommendations for organizational changes aimed at consolidating some activities, changing chains of command, opening lines of communications, and modifying policies to achieve greater responsibility and accountability. Many changes have been implemented within the last few months, and thus related processes and procedures have not been completed. As a result, it is too early to determine whether these changes will enable DOD to promote and protect U.S. interests in space more effectively. Moreover, DOD has not yet completed plans for achieving some long-range goals, such as developing a cadre of space professionals and integrating military and intelligence space activities. The Secretary of Defense chose not to implement three of the commission's recommendations and is instead (1) opting to establish a focal point for space within the Air Force rather than an under secretary of defense, (2) increasing the Air Force's responsibilities for space activities by department directive rather than requesting legislative change, and (3) directing existing organizations to conduct innovative space research and development rather than create a new organization.

It also posits military-commercial sector linkages as the best near-term road map for future development. As commercial activities expand the importance of United States space, and as technological advances enable military missions, Hays sees expanded military roles, including space weaponization, on the horizon. He concludes that military space has already had a significant impact on the American way of war. That trend will only continue as the promise of a true space-led revolution in military affairs awaits eventual space weaponization. Given an increasingly important U.S. commercial and military presence in space, the second paper, "Space-Related Arms Control and Regulation to 2015: Precedents and Prospects," presents a detailed analysis of existing regulations and controls that constrain and shape military space use and development. It also presents a comprehensive examination of current and future issues that will define likely arenas of international efforts to further control military space. The United States must be very aware of the possible consequences for its overall commercial and military space efforts in addressing these issues. Finally, the paper suggests areas where some current regulatory emphasis could benefit the United States, indicating areas for current policy emphasis. Together, the two papers provide a timely and important examination of the current state and the likely future of United States military space.

Book excerpt: "Historically, strategic restraint was the dominant approach among nations active in outer space, all of whom understood that continued access to and use of space required holding back on threats or activities which might jeopardize the status quo of peace in space. However, recently there has been a discernible shift in international rhetoric towards a more offensive approach to defense in space. The U.S. move towards establishing a "Space Force" has been echoed by similar announcements in France and Japan. India launched an anti-satellite weapon test and announced proudly that it thereby joined the elite group of China, Russia and the U.S., who have all demonstrated this capability in the past. And as technologies in space advance, along with our terrestrial dependence on space-based systems for our peaceful civilian lives and for support of terrestrial warfare, the political stability of this vulnerable environment comes under threat. These factors, combined with a lack of transparency about actual capabilities and intentions on the part of all major players in space, creates a cyclical escalation which has led some commentators to describe this as a return to a Cold War-type arms race, and to the foreseeability of a space-based conflict. Due to many unique characteristics of the space domain, an armed conflict in space would be catastrophic for all players, including neutral States, commercial actors, and international civil society. Due to the specificity of the space domain, specialized expertise must be provided to decision-makers, and interdisciplinary opinions must be sought from a multitude of stakeholders. To that end, this volume provides a wide spectrum of perspectives from experts who have engaged together at a conference hosted by the Center for Ethics in the Rule of Law to discuss these issues.
