Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is approving two State Implementation Plan (SIP) revisions, submitted by the State of Florida, through the Florida Department of Environmental Protection (FL DEP), to EPA on April 3, 2015, for the purpose of providing for attainment of the 2010 primary Sulfur Dioxide (SO 2) National Ambient Air Quality Standard (NAAQS) in the Hillsborough County and Nassau County SO 2 nonattainment areas (hereafter referred to as the "Hillsborough Area," "Nassau Area," or "Areas"). The Hillsborough Area is comprised of the portion of Hillsborough County in Florida surrounding the Mosaic Fertilizer facility (hereafter referred to as "Mosaic"). The Nassau Area comprises the portion of Nassau County in Florida surrounding the Rayonier Performance Fibers, LLC sulfite pulp mill (hereafter referred to as "Rayonier"). EPA concludes that Florida has appropriately demonstrated that attainment with the 2010 1-hour primary SO 2 NAAQS will occur in the Nassau and Hillsborough Areas by the applicable attainment dates, and that the plans meet the other applicable requirements under the Clean Air Act (CAA or Act). As a part of approving the attainment demonstrations, EPA is taking final action to approve into the Florida SIP the SO 2 emissions limits and associated compliance parameters for both Areas. Book excerpt: In response to a congressional request, GAO reviewed: (1) the Environmental Protection Agency's (EPA) approval of state actions to allow increased levels of sulfur dioxide emissions; (2) the impact of such revisions on future economic growth; and (3) the legal basis for these increases. GAO found that, from 1981 to 1983, EPA approved 114 revisions to state implementation plans involving sulfur dioxide, 58 of which permitted increased emissions. These revisions allowed a net increase of 1.5 million tons of sulfur dioxide emissions during that period. The GAO review of 18 state plan revisions showed that increased sulfur dioxide emissions could reduce the recreational value of land and waterways, increase building maintenance costs, and increase health care expenses. After a state's adoption and submission to EPA of a state plan revision, EPA approval is mandatory and the revision must meet Clean Air Act criteria. However, states are allowed to attach conditions to their state plan revisions. GAO found that: (1) for the 18 state plan revisions it reviewed, EPA and the states followed the act's key requirements; (2) EPA could improve the techniques it uses in making approval decisions; (3) mathematical models are needed that can better project the interstate impacts of sulfur dioxide emissions and the impact of those emissions on certain types of terrain; and (4) some states calculated compliance with the emission standards by a method that was not approved by EPA. EPA, however, has ongoing research to find methods of correcting these problems.

In this action, EPA is approving the Colorado Interstate Transport SIP provisions that address the requirement of section 110(a)(2)(D)(i) that emissions from Colorado sources do not significantly contribute to nonattainment of the 1997 PM 2.5 NAAQS in any other state, interfere with maintenance of the 1997 PM 2.5 NAAQS by any other state, or interfere with any other state's required measures to prevent significant deterioration of air quality for the 1997 PM 2.5 and 8-hour ozone NAAQS. EPA is also approving certain revisions to Colorado Regulation No. 3 submitted by the State of Colorado in separate prior submissions. This action is being taken under section 110 of the CAA. Updated as of May 29, 2018 Pursuant to sections 110(a)(2)(H) and 110(k)(5) of the Clean Air Act (CAA), EPA is finding that the Utah State Implementation Plan (SIP) is substantially inadequate to attain or maintain the national ambient air quality standards (NAAQS) or to otherwise comply with the requirements of the CAA and issuing a call for the State of Utah to revise its SIP. Specifically, the SIP includes Utah's unavoidable breakdown rule (rule R307-107), which exempts emissions during unavoidable breakdowns from compliance with emission limitations. This rule undermines EPA's, Utah's, and citizens' ability to enforce emission limitations that have been relied on to ensure attainment or maintenance of the NAAQS or meet other CAA requirements. EPA is requiring that the State revise the SIP to remove R307-107 or correct its deficiencies and submit the revised SIP to EPA within 18 months of the effective date of this final rule. If EPA finds that Utah has failed to submit a complete SIP revision as required by this final rule or if EPA disapproves such a revision, such a finding or disapproval will trigger clocks for mandatory sanctions and an obligation for EPA to impose a Federal Implementation Plan (FIP). If EPA makes such a finding or disapproval, mandatory sanctions will apply such that the offset sanction would apply 18 months after such finding or disapproval and highway funding restrictions would apply six months later unless EPA takes action to stay the imposition of the sanctions or to stop the sanctions clock based on the State curing the SIP deficiencies.
