Book The Governance Gap

Download or read book The Governance Gap written by Penelope Simons and published by Routledge. This book was released on 2014-07-11 with total page 461 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the persistence of the governance gap with respect to the human rights-impacting conduct of transnational extractive corporations operating in zones of weak governance. The authors launch their account with a fascinating case study of Talisman Energy’s experience in Sudan, informed by their own experience as members of the 1999 Canadian Assessment Mission to Sudan (Harker Mission). Drawing on new governance, reflexive law and responsive law theories, the authors assess legal and other non-binding governance mechanisms that have emerged since that time, including the UN Guiding Principles on Business and Human Rights. They conclude that such mechanisms are incapable of systematically preventing human rights violating behaviour by transnational corporations, or of assuring accountability of these actors or recompense for victims of such violations. The authors contend that home state regulation, while not a silver bullet, has a crucial role to play in regulating such conduct. They pick up where UN Special Representative John Ruggie’s Guiding Principles on Business and Human Rights left off, and propose an innovative, robust and adaptable template for strengthening the regulatory framework of home states. Their model draws insights from the theoretical literature, leverages existing public, private, transnational, national, ‘soft’ and hard regulatory tools, and harnesses the specific strengths of state-based governance. This book will be of interest to academics, policy makers, students, civil society and business leaders.

Download or read book From Peacekeeping to Peacemaking written by Nicholas Gammer and published by McGill-Queen's Press - MQUP. This book was released on 2001 with total page 262 pages. Available in PDF, EPUB and Kindle. Book excerpt: This examination of Canada's response to the disintegration of the Federal State of Yugoslavia considers how Canadian foreign policy was formed, and the role of the prime minister in this decision-making. Gammer (political science, Okanagan University College) argues that Mulroney used his office to redefine international standards on humanitarian intervention. Gammer also outlines the risks in doing this, and considers the impact of Mulroney's stance on the behavior of Canadian troops. He considers the role of political leadership in foreign affairs, and its relationship to legitimacy. c. Book News Inc.

Book The Sleeping Giant Awakens

    Book Details:
  • Author : David B. MacDonald
  • Publisher : University of Toronto Press
  • Release : 2019-05-09
  • ISBN : 1487518056
  • Pages : 253 pages

Download or read book The Sleeping Giant Awakens written by David B. MacDonald and published by University of Toronto Press. This book was released on 2019-05-09 with total page 253 pages. Available in PDF, EPUB and Kindle. Book excerpt: Confronting the truths of Canada’s Indian residential school system has been likened to waking a sleeping giant. In The Sleeping Giant Awakens, David B. MacDonald uses genocide as an analytical tool to better understand Canada’s past and present relationships between settlers and Indigenous peoples. Starting with a discussion of how genocide is defined in domestic and international law, the book applies the concept to the forced transfer of Indigenous children to residential schools and the "Sixties Scoop," in which Indigenous children were taken from their communities and placed in foster homes or adopted. Based on archival research, extensive interviews with residential school Survivors, and officials at the Truth and Reconciliation Commission of Canada, among others, The Sleeping Giant Awakens offers a unique and timely perspective on the prospects for conciliation after genocide, exploring the difficulties in moving forward in a context where many settlers know little of the residential schools and ongoing legacies of colonization and need to have a better conception of Indigenous rights. It provides a detailed analysis of how the TRC approached genocide in its deliberations and in its Final Report. Crucially, MacDonald engages critics who argue that the term genocide impedes understanding of the IRS system and imperils prospects for conciliation. By contrast, this book sees genocide recognition as an important basis for meaningful discussions of how to engage Indigenous-settler relations in respectful and proactive ways.
