Since then the book has gone through five more editions and has been translated into Spanish and Italian. The present English translation is based on the sixth German edition. The author was Professor of Economics at the University of Freiburg, Germany. Professor Eucken was a student at a time when the Historical School dominated the teaching of econo mics at the German universities. Although, at the beginning of his career, he did some work along the lines of the Historical School, neither the ~ims nor the methods of historical research the field of economics as practised by the representatives in of the Historical School satisfied him; and the fact that the members of this school were unable to explain the causes of economic events such as the German inflation after World War I was an added reason for him to turn to economic theory. He became, among German economists, the foremost opponent of the Historical School, which he criticised in several publica tions. Through his wrItings and his teaching he contributed his share to the revival of interest in economic theory which was noticeable in the 'twenties. And he was one of the few economists left in Germany who helped to keep this interest alive during the 'thirties and during World War II. During this time he published Kapitaltheoretische Untersuchungen (1936), and the present volume, which immediately gave rise to an extensive discussion in German economic journals.

Book excerpt: In September 2018 the criminal law section of the 72nd Deutscher Juristentag (DJT, “German Assembly of Jurists”) debated the question “Sentencing Guidelines vs. Free Judicial Discretion – Is German Sentencing Law in Need of Reform?” Despite the expert opinion provided by Johannes Kaspar and the accompanying scholarly commentaries, ensuing proposals for fundamental reform met with rejection. The comparative perspective was limited to the US Federal sentencing guidelines. The intention of this volume is therefore, on the one hand, to draw a more nuanced picture of Anglo-American sentencing law focusing on three legal systems (England/Wales, USA and Canada) accompanied by commentaries from a German perspective; on the other hand, we want to make the German perspective (better) known within the Anglo-American legal world by reproducing important DJT documents in English language. To ensure the widest possible distribution we opted for a bilingual open access publication.

A History of Twentieth-Century Germany provides a survey of German history during a century of extremes. Ulrich Herbert sees German history in the 20th century as determined by two contradictory perspectives. On one hand, there are the world wars and great catastrophes that divide the country's history into two parts-before and after 1945. Germany is the birthplace of radical ideologies of the left and right and the only country in which each ideology became the foundation of government. This pattern left its stamp on both the first and second halves of the century. On the other hand, the rise of modern industrial society led to decades of conflict over the social and political order regardless of which political system was in force. Considering these contradictory developments, Herbert tackles the questions of both the collapse in the first half of the century and the development from a post-fascist, ruined society to one of the most stable liberal democracies in the world in the latter half. Herbert's analysis brings together wars and terror, utopia and politics, capitalism and the welfare state, socialism and liberal democratic society, gender and generations, culture and lifestyles, European integration and globalization. The resulting book sets a standard by which historians of the period will be measured in the future.

Translations barely penetrate the meaning of the word, which has provided the emotional and ideological common ground for a variety of associations and individuals devoted to the cause of local preservation. Celia Applegate examines at both the national and regional levels the cultural meaning of Heimat and why it may be pivotal to the troubled and very timely question of German identity. The ideas and activities clustered around Heimat shed new light particularly on problems of modernization. Instead of viewing the Germans as a dangerously anti-modern people, Applegate argues that they used the cultivation of Heimat to ground an abstract nationalism in their attachment to familiar places and to reconcile the modern industrial and urban world with the rural landscapes and customs they admired. Primarily a characteristic of the middle classes, love of Heimat constituted an alternative vision of German unity to the familiar aggressive, militaristic one. The Heimat vision of Germany emphasized cultural diversity and defined German identity by its internal members rather than its external enemies. Applegate asks that we re-examine the continuities of German history from the perspective of the local places that made up Germany, rather than from that of prominent intellectuals or national policymakers. The local patriotism of Heimat activists emerges as an element of German culture that persisted across the great divides of 1918, 1933, and 1945. She also suggests that this attachment to a particular place is a feature of Europeans in general and is deserving of further attention. A unified conceptual and explanatory framework is used to describe trajectories of state change, to explain the internationalization or privatization of responsibilities in the resource, law, legitimacy and welfare dimensions of the democratic nation state, and to probe the state's role in the today's post-national constellation of political authority. As the contributions show, an unravelling of state authority has indeed occurred, but the state nevertheless continues to play a key role in emerging governance arrangements. Hence it is not merely a 'victim' of globalization and other driving forces of change.
