Book excerpt: Excerpt from Speeches and Occasional Addresses, Vol. 1 The Territory on the northwest coast of America, west of the Rocky Mountains, known as Oregon, and long in dispute between the United States and Great Britain, was, by a convention between the two countries, concluded on the 20th October, 1818, made free to the vessels, citizens, and subjects of both, for the period of ten years. This agreement was continued in force and indefinitely extended by the convention of 26th August, 1827. In consequence of collisions between the people of the two countries within the disputed Territory, resolutions were introduced into the Senate, in February, 1846, requiring the President to give notice of the abrogation of the last-mentioned convention, in accordance with one of its stipulations. A portion of the senators were in favor of adjusting the controversy by adopting the 49th parallel of latitude as the boundary, leaving to Great Britain the territory north of it; and the others of insisting on the abandonment by Great Britain of the whole country as far north as 54 40', from which line northward the title of Russia had been acknowledged by both the parties to the pending dispute. Mr. Dix, while asserting the title of the United States to the whole Territory derived from the discoveries and occupation of Spain, was nevertheless in favor of the compromise line of 49, which had been offered to Great Britain in pi-previous negotiations. The question was settled by the adoption of that parallel as the boundary line, under a treaty negotiated by Mr. Louis McLane, and ratified by the Senate at the same session in which the debate took place. For my own part, I believe, for I had not then the honour of a seat in this House, that this was the case in discussing another bill of great importance, the Irish Municipal Bill - the general principle of the bill having been approved of, it was read a second time with the support of many hon. Members, although several divisions were subsequently taken by them upon its details. Sir, I have no hesitation in stating, that I do believe that the evils which are to be apprehended from the restriction of the franchise in Ireland are greater than those which are to be dreaded from its extension. Sir, whether the test of my noble Friend should be adopted or not, I should see with satisfaction that a greater proportion of votes should be given to the large counties of Cork and Down. I think it better that they should have 8,000 rather than 2,000 voters, but whether they are to have 8,000 or 2,000, still I prefer the test of my noble Friend near me to the undefined franchise in the bill of the noble Lord. Sir, I shall at present not touch upon the question of the amount of the franchise - I shall confine myself to the principle of the bill, and it will be necessary for me to follow the example of the noble Lord, and look, not at my noble Friend's bill alone, but also at the other bill that accompanies it on the table of the House. The case is certainly a grave and important one, for it involves a right which is the foundation of all other rights. Serious evils are admitted to exist with regard to that precious and important right; both parties in the State admit the existence of these evils, and both have come forward with remedies which are now lying on your table, and it is for the House to decide between them. There have always been, perhaps in the nature of the case there must always be, at least two forms of rhetoric, often typified by the examples of Demosthenes and Cicero. There is the 'keen, terse, argumentative style, to be found in the great Athenian. There is the elaborate, or ornamental, decorative kind, of Which Cicero was the most consummate master, which aims less at the achievement of an immediate object than at the production of a general result. Neither kind can be excluded from any really representative series. Yet it must not be supposed that the two sorts of Speaking can always be separated, or that they are never found in the same speech. There must be some general proposition at the back of every practical scheme. There must be some particular inference to be drawn from every general rule. Much as the characters of speeches may vary, they have the common element of being all made for persuasion. A speech which does not persuade is useless. There are, how ever, examples of the eloquence which results from intense personal conviction, and has no ulterior motive, the eloquence of feeling. Book excerpt: Excerpt from Speeches and Occasional Addresses, Vol. 2 By this act, it will be perceived that the laws of the States in relation to pilotage were recognized by Congress at its first session after the Constitution was adopted, and that, by refer ring to the future as well as the existing legislation of the States, it designed to place the whole subject prospectively under State regulation. Congress undoubtedly saw that this was one of those cases in which each State would be best capable of judging for itself what regulations the subject would require within its own limits, and that in providing for its own interest, that of the public would be most likely to be secured. From 1789 to 1837 this was the established sys tem in respect to the regulation of all that relates to pilotage. Though the section I have read contemplated the possibility of future legislation by Congress, no further act was passed during a period of forty-eight years. I have not been able to find any other act referring to pilots in any manner, except the act of 1792, establishing a uniform militia, by which they were exempted from militia duty. Most of them were prepared for some special emergency: only two papers, that on "The Relation of Jesus to his Age and the Ages," and that on "Immortal Life," were written without reference to some such emergency. All of them have been printed before, excepting the sermon "Of General Taylor," and the address on "The American Scholar;" some have been several times reprinted. I do not know that they are worthy of republication in this permanent form, but the leading ideas of these volumes are very dear to me, and are sure to live as long as the human race shall continue. So I have published a small edition, hoping that the truths which I know are contained in these pages will do a service long after the writer, and the-occasion of their utterance, have passed off and been forgot.
