Download or read book American Sanctuary written by A. Roger Ekirch and published by Vintage. This book was released on 2018-11-20 with total page 322 pages. Available in PDF, EPUB and Kindle. Book excerpt: In 1797 the bloodiest mutiny ever suffered by the Royal Navy took place on the British frigate HMS Hermione off the coast of Puerto Rico. Jonathan Robbins, a reputed American sailor who had been impressed into service, made his way to American shores. President John Adams bowed to Britain’s request for his extradition. Convicted of murder and piracy by a court-martial in Jamaica, Robbins was hanged. Adams’s catastrophic miscalculation ignited a political firestorm, only to be fanned by Robbins’s failure to receive his constitutional rights of due process and trial by jury by an American court. American Sanctuary brilliantly lays out in riveting detail the story of how the Robbins affair, amid the turbulent presidential campaign of 1800, inflamed the new nation and set in motion a constitutional crisis, resulting in Adams’s defeat and Thomas Jefferson’s election as the third president of the United States. Robbins’s martyrdom led directly to the country’s historic decision to grant political asylum to foreign refugees—a major achievement in fulfilling the promise of American independence.

Download or read book The Political Economy of Democracy and Tyranny written by Norman Schofield and published by De Gruyter Oldenbourg. This book was released on 2009 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: One theme that has emerged from the recent literature on political economy concerns the transition to democracy: why would dominant elites give up oligarchic power? This book addresses the fundamental question of democratic stability and the collapse of tyranny by considering a formal model of democracy and tyranny. The formal model is used to study elections in developed polities such as the United States, the United Kingdom, the Netherlands, Canada, and Israel, as well as complex developing polities such as Turkey. The key idea is that activist groups may offer resources to political candidates if they in turn adjust their polities in favor of the interest group. In polities that use a "first past the post" electoral system, such as the US, the bargaining between interest groups and candidates creates a tendency for activist groups to coalesce; in polities such as Israel and the Netherlands, where the electoral system is very proportional, there may be little tendency for activist coalescence. A further feature of the model is that candidates, or political leaders, like Barack Obama, with high intrinsic charisma, or valence, will be attracted to the electoral center, while less charismatic leaders will move to the electoral periphery. This aspect of the model is used to compare the position taking and exercise of power of authoritarian leaders in Portugal, Argentina and the Soviet Union. The final chapter of the book suggests that the chaos that may be induced by climate change and rapid population growth can only be addressed by concerted action directed by a charismatic leader of the Atlantic democracies.

Download or read book Rights and Private Law written by Donal Nolan and published by Bloomsbury Publishing. This book was released on 2011-12-02 with total page 582 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years a strand of thinking has developed in private law scholarship which has come to be known as 'rights' or 'rights-based' analysis. Rights analysis seeks to develop an understanding of private law obligations that is driven, primarily or exclusively, by the recognition of the rights we have against each other, rather than by other influences on private law, such as the pursuit of community welfare goals. Notions of rights are also assuming greater importance in private law in other respects. Human rights instruments are having an increasing influence on private law doctrines. And in the law of unjust enrichment, an important debate has recently begun on the relationship between restitution of rights and restitution of value. This collection is a significant contribution to debate about the role of rights in private law. It includes essays by leading private law scholars addressing fundamental questions about the role of rights in private law as a whole and within particular areas of private law. The collection includes contributions by advocates and critics of rights-based approaches and provides a thorough and balanced analysis of the relationship between rights and private law.
