First, executive power has been continuously strengthened at the EU level in the form of the European Commission, EU-level agencies and diplomatic and military staff in the Union Council secretariat. Second, EU executive bodies relate directly to (regulatory) authorities at the national level in charge of applying (and partly preparing) EU laws and programmes, partly circumventing ministerial departments. Thus, parts of national administrations become parts of an integrated and multi-level Union administration as well as parts of national executives. Such a system with multiple political masters raises delicate questions about political steering and accountability. This book focuses on this fascinating development both from a political science and a legal perspective, encompassing the consolidation of the supranational executive as well as its relationships with its ‘partners’ at the national level. This book was published as a special issue of West European Politics.

Book excerpt: Ongoing transformations of the political organization of Europe, where both the nation-state and the European Union are challenged, make it possible to explore phenomena that are difficult to see in stable periods. An upsurge in accountability-demands, where political leaders are required to explain and justify what they are doing, is one such phenomenon. Mainstream approaches to democratic accountability, assuming settled principal-agent relations may give insight into the routines of institutional accountability. This book argues that it is not enough to analyze how accountability processes contribute to routinized maintenance of an established order within relatively stable, simple, and well-known situations. We need to understand accountability in eras of institutional confusion and contestation and in dynamic, complex, and unknown situations. First, variations in the relations between democratic accountability and political association, organization, and agency are endogenous to politics. Second, accountability processes take place within both settled and unsettled orders. They can be both order-maintaining and order-transforming. Third, accountability involves sense-making as well as decision-making. Fourth, accountability may involve mass mobilization or go on largely unnoticed by the public. Fifth, accountability processes may or may not foster new ideas about political order, government, and the role of rank-and-file citizens in political life. They may or may not affect what democracy will mean and imply in the future. The aim of this book is twofold: to contribute to the theorization of democratic accountability and to discuss what accountability processes tell us about political order and orderly change in general.

Nevertheless, as the events of the last decade made clear, the EU's complex system of governance has been unable to achieve a democratic or constitutional legitimacy in its own right. In Power and Legitimacy: Reconciling Europe and the Nation-State, Peter L. Lindseth traces the roots of this paradox to integration's dependence on the postwar constitutional settlement of administrative governance on the national level. Supranational policymaking has relied on various forms of oversight from national constitutional bodies, following models that were first developed in the administrative state and then translated into the European context. These national oversight mechanisms (executive, legislative, and judicial) have over the last half-century developed to address the central disconnect in the integration process: between the need for supranational regulatory power, on the one hand, and the persistence of national constitutional legitimacy, on the other. In defining the ways European public law has sought to reconcile these two conflicting demands, Professor Lindseth lays the foundation for a better understanding of the "administrative, not constitutional" nature of European governance going forward.

Moreover, the organizational (independent) variables outlined in this book represent classical dimensions in the organization literature that are generic in character.
