Book excerpt: The Multilateral Agreement on Investment (MAI), under negotiation since 1995, was conceived as a free-standing treaty that would eventually apply to all countries, constituting the global rules on investment-related matters. The proposed agreement would provide a broad multilateral framework for international investment with high standards for the liberalization of investment regimes and investment protection. This report describes the work from February to March 1999 of a British Columbia committee appointed to examine and make recommendations with respect to the draft MAI. The committee work included holding public hearings on the MAI throughout the province. The introduction to the report briefly reviews the MAI and the committee's first report. Part one describes the committee's work in the context of recent events concerning international investment negotiations. It reviews the current status of negotiations on international investment rules and the work of other legislative bodies in examining the MAI. Part two highlights British Columbians' concerns about international trade and investment provisions similar to those contained in the MAI. This section considers the ramifications of international investor/state dispute settlement processes for British Columbia, examines how MAI-style rules would affect the province's economic development, municipal governments, small businesses, and local employment & benefits, and also discusses the role of foreign direct investment and the impact of international investment rules on international development and international financial stability. The final part sets out lessons learned from the MAI process and how they may be applied in future international investment negotiations. This section considers the impact of MAI-like rules on sovereignty & democratic accountability, and reviews essential preconditions that must be fulfilled before Canada engages in further international investment negotiations. It also includes the committee's recommendations. The report incorporates numerous excerpts from testimony provided at the public hearings. Additional selected quotations are collated in the appendix.

Book excerpt: The Committee on Foreign Investment in the United States (CFIUS) is comprised of nine members, two ex officio members, and other members as appointed by the President representing major departments and agencies within the federal executive branch. While the group generally has operated in relative obscurity, the proposed acquisition of commercial operations at six U.S. ports by Dubai Ports World in 2006 placed the group's operations under intense scrutiny by Members of Congress and the public. Prompted by this case, some Members of the 109th and 110th Congresses questioned the ability of Congress to exercise its oversight responsibilities given the general view that CFIUS's operations lack transparency. Other Members revisited concerns about the linkage between national security and the role of foreign investment in the U.S. economy. Some Members of Congress and others argued that the nation's security and economic concerns have changed since the September 11, 2001, terrorist attacks and that these concerns were not being reflected sufficiently in the Committee's deliberations. In addition, anecdotal evidence seemed to indicate that the CFIUS process was not market neutral. Instead, a CFIUS investigation of an investment transaction may have been perceived by some firms and by some in the financial markets as a negative factor that added to uncertainty and may have spurred firms to engage in behavior that may not have been optimal for the economy as a whole. On July 12, 2016, Senator Charles Grassley introduced S. 3161 to include the Secretary of Agriculture as a permanent member of the CFIUS and to include the national security impact of foreign investments on agricultural assets as part of the criteria the Committee uses in deciding to recommend that the President block a foreign acquisition.
