Book excerpt: Although the recognition of States is a common occurrence in international relations and retains a central position in discussions of international law, its nature and legal effects have remained controversial well into the twenty-first century. While some believe that recognition plays a fundamental role in the creation of statehood, others deny recognition any legal value. Regardless, debates surrounding any case where statehood is disputed will sooner or later turn to the matter of recognition, or lack thereof, by other States. This book challenges the widespread views of statehood as an absolute or empirical fact and of recognition as merely declaratory in the creation of States as the primary and original persons of international law. Drawing upon a comparative analysis of contested States ranging from Palestine and Kosovo to Somaliland and Eastern Ukraine, this book seeks to ascertain the normative value and the effects of the act of recognition in various situations, distinguishing between: cases where statehood may be inferred from applicable rules of international law, cases where statehood could only be explained by recognition, and cases where the establishment of a State is prevented by international legal norms. In addition to discussing a range of issues related to recognition, this book provides an up-to-date overview of the history of recognition, the positions of various governments, and a broad, critical summary of domestic and international jurisprudence.

Book excerpt: The emergence of new states and independence movements after the Cold War has intensified the long-standing disagreement among international lawyers over the right of self-determination, especially the right of secession. Knop shifts the discussion from the articulation of the right to its interpretation. She argues that the practice of interpretation involves and illuminates a problem of diversity raised by the exclusion of many of the groups that self-determination most affects. Distinguishing different types of exclusion and the relationships between them reveals the deep structures, biases and stakes in the decisions and scholarship on self-determination. Knop's analysis also reveals that the leading cases have grappled with these embedded inequalities. Challenges by colonies, ethnic nations, indigenous peoples, women and others to the gender and cultural biases of international law emerge as integral to the interpretation of self-determination historically, as do attempts by judges and other institutional interpreters to meet these challenges.

Book excerpt: European Identity examines how Europe is represented linguistically in the news media of four EU countries, France, Italy, Poland, and the UK, through the use of an electronic corpus built from newspapers and television news transcripts. This multilingual comparable corpus, is composed of the entire contents of four newspapers published in each country, collected over two periods of three months, and the transcriptions of two TV news broadcasts, collected over two periods of two months. The theoretical and methodological frameworks adopted include discourse analysis, corpus linguistics and corpus-assisted discourse analysis. The individual chapters investigate various aspects of European identity as it is discursively construed in the news media of the different countries, such as Europe as a political and geographic entity, European Union institutions, European history, citizenship, and immigration. Based on a bottom-up orientation and using both quantitative and qualitative methods, all chapters but one use a comparative approach to the data, juxtaposing the journalist representations of Europe in two or more languages. The fundamental aim of the volume is to demonstrate how linguistic analysis, and in particular the study of large amounts of linguistic data, can make a vital contribution to the analysis of political and social issues

It explores different dimensions of private and public apparatuses through which the governmentality of child trafficking manifests itself at a regional and interregional level. It investigates questions linked to the diffusion of the child trafficking norm between and within regions and stakeholders; to the criminalization and vulnerabilization of child traffickees; and to private governance of anti-trafficking initiatives, in particular concerning social sustainability of business supply chains. Drawing on extensive fieldwork with government, police, justice, civil society, multilateral organizations, and businesses in the EU and in ASEAN, the book argues that child traffickees are subjected not only to physical and psychological violence but also to structural violence. Neue Ideen entwickelte Friedrich - so umstritten manche (vor allem in der Totalitarismusforschung) gewesen sein mogen - besonders in der Erfor schung des Konstitutionalismus, des Foderalismus und des Totalitarismus. Seine bekanntesten Beitriige zur Systematisierung der Forschungsergebnisse sind die Werke "Constitutional Government and Democracy" (1937 if.) und "Man and His Government" (1963).
