The writer tried to convey his conviction that the question of Government ownership of public utilities and especially railroads in the United States is essentially one not of railroad management and operation itself, but of general economics and politics. To his mind, Government ownership of public utilities means absolute Government control not only of the industries but also of the politics in the various States and in the Union generally. It means practically, if not formally, abolition of our democratic institutions and of the very spirit of democracy, and substitutes for the rule of the people, for the people, and by the people, an autocracy of the central government. It means abolition of the present division of the country into forty-eight sovereign and independent States, and reduction of the States to simple electral districts, as well as loss by the States of their rights to tax railroad properties within their boundaries as an exercise of their right of sovereignty. It means also forcing into politics our great corporations, and introducing a spirit of corruption and political subserviency at a time when the spirit of militant democracy is awakened in the land by the events of the past four years. It means also giving one of the most potent arguments into the hands of the extreme socialist groups and thus reinforcing the sinister cohorts of enemy and Bolshevist propaganda. The writer desires to make it perfectly clear that at no time does he wish to imply that advocates of Government ownership are harboring such intentions as abolishing the democratic institutions of this country or assisting the enemy in his vicious endeavor to disorganize and destroy our nation. In a matter of national life, however, it is not the intentions that count but the facts, and it is with facts and not intentions that the author of the present book has tried to deal. Section 925 - 98.When cities own the water works or lighting works the water rates or charges for lighting shall be collected by the treasurer and be first devoted to the expense of maintaining and operating the works, paying the principal and interest of any indebtedness created in the construction or purchase thereof, and the balance, if any, shall be paid into the general fund. The common council of every city which shall construct or own and operate lighting works or water works to supply the city and its inhabitants with light or water may, by ordinance, fix the rates to be charged for light or water furnished the inhabitants thereof, and provide for the collection of the same either quarterly or semi-annually in advance or otherwise provided, such rates, shall be uniform for like services in all parts of the city. The provisions of the next following section shall apply to the listing and collection of unpaid rates or charges for light or water so furnished, so far as they are applicable. Ch. 367, 1909. Water mains, when owned by city; expenses. Section 925 - 106.The preceding provisions relating to the construction of water mains in whole or in part at the expense of abutting owners shall not apply except in cases where the city owns the works, and in cases where the water works are now owned or may hereafter be purchased by the city the extensions of mains after such purchase shall be made at the expense of the city at large or at the expense of abutting property as the council shall determine. This is essential in order to determine the capitalization upon which rates are to'be estimated. With out such a basis the regulation of rates would be practically impossible. However, in view of the many theories advanced for determining capitalization no specific rule is prescribed bythe statute. The act merely commands the Commission to value all of the property of every public utility actually used and useful for the convenience of the public, and to make a sepa rate valuation of all the physical property of such utility so used and useful. Every element of value, both tangible and intang ible, is to be considered in reaching a result, excepting only franchise values, which are necessarily excluded 'by the general policy of the law. The object to be attained is the fair value of the property as a going concern. This, in the contemplation of the statute, is the proper capitalization upon which returns must be allowed. Book excerpt: Excerpt from Draft Bill for the Regulation of Public Utilities: With Documents Relating Thereto In 1907, the National Civic Federation appointed a Commission on Public Ownership and Operation to investigate, in this country and abroad, the history of such movements up to that date. The commission was thoroughly representative, and embraced in its membership men who believed in public ownership and operation, and men who did not; it embraced representatives of organized labor, and men interested in the private ownership and operation of public utilities; it embraced students of the subject, and men engaged in the actual regulation of public utilities as members of public commissions. This commission reported that public utilities from their nature tend to become and ought to be monopolies; and that unregulated monopoly in so important a field is impossible. In view of this conclusion, The National Civic Federation, in 1911, called another conference of people interested in this subject; as a result of which it was determined to create a department to prepare a draft bill for the Public Regulation of Interstate and Municipal Utilities. Enquiry revealed the fact that every state in the union has a regulative commission of some sort, except the states of Delaware, Wyoming, and Utah. This development has been not only extensive but intensive. Cities have increased not only in number but also in size, and not only are the problems incident to urban life becoming of interest to greater and still greater numbers of persons but the solution of these problems is at the same time becoming more difficult and more necessary. One of the methods of solving these problems is the extension of the sphere of municipal activity. At one time our conception of a city, similar to our conception of the government as a whole, was that it was an organization which should preserve order and, within the limits of the law which it was its duty to enforce, permit the greatest possible freedom of action to the individual, from whose initiative and energetic activity it was believed that the community as a whole would derive the utmost advantage. It was found, however, however, that unregulated or insufficiently regulated individual activity was followed in the life of our urban communities by such evils that it became necessary to have greater and greater recourse to the repressive activity of municipal as well as state governmental organs. Such repressive activity was believed at first in many instances to be inconsistent with the guarantees of individual rights contained in our constitutions.
