In Seeing Sodomy in the Middle Ages, Robert Mills explores the relationship between sodomy and motifs of vision and visibility in medieval culture, on the one hand, and those categories we today call gender and sexuality, on the other. Challenging the view that ideas about sexual and gender dissidence were too confused to congeal into a coherent form in the Middle Ages, Mills demonstrates that sodomy had a rich, multimedia presence in the period—and that a flexible approach to questions of terminology sheds new light on the many forms this presence took. Book excerpt: This collection was compiled by Francis Loots on behalf of GALA, following a search for documents on cases of sodomy in the Cape Archives. The collection consists of the search results, indexes and summaries of Circuit Court, Supreme Court and Appeal Court sodomy cases, as well as photocopies, transcriptions and English translations of some of the original Afrikaans documents in the Cape Archives (1828-1961). A computer printout of search results (117 sodomy cases) forms the basis of the collection. Loots summarised each sodomy case individually, recording the name of the accused, occupation, place and date of assault as a heading to each case, followed by the Cape Archives file/volume reference number, the computer search result number, a description of the case, and a detailed description of documents in the Cape Archives for each case. Photocopies of original documents are attached to most of the summaries, as well as transcribed documents in some instances, and English translations where the original documents are in Afrikaans. Loots did not retain the order and numbering (no. 1-117) of the documents as listed in the search results, but allocated his own numbers (marked at the top right hand corner of each case summary), and sorted the records according to the following categories for which he compiled 3 indexes.: Criminal records, Cape Supreme Court, 1828-1957, Charge: Sodomy (Numbers 1-64). Criminal records, Circuit Court of the Cape Supreme Court, 1828-1961, Charge: Sodomy (Numbers 65-112). Criminal records, Cape Supreme Court, Criminal appeals, 1927-1940, Charge: Sodomy (Numbers 113-116). This order has been retained in the archival arrangement of the sodomy case materials in series B. Search result number 4 (of 117) has been annotated as a "mistake" on the computer printout and related documents have not been included in this collection. The dates in the inventory refer to the dates of sodomy cases, as reflected in the search results, recorded in the case summaries and in the original case documents from the Cape Archives. The case summaries would have been compiled in 1999, along with the transcribing and translation of some of the original case documents. A floppy disk contains the digital-born documents created by Loots: the indexes and the Circuit Court, Supreme Court and Appeal Court case summaries, a translation of witness testimony in the case of Rex Vs Bertwyn Cobhan Norton (B106), and a transcription of witness testimony and statement in the case of Rex Vs Albert Brentall Stone (B116). The collection further includes a PhD thesis by Tecla Aerts on sodomy on VOC ships in the 18th Century (in Dutch).

Even in the seventeenth century, simply speaking of the act was cause for censorship. Here, in the first history of sodomy in these countries, Helmut Puff argues that accusations of sodomy during this era were actually crucial to the success of the Protestant Reformation. Drawing on both literary and historical evidence, Puff shows that speakers of German associated sodomy with Italy and, increasingly, Catholicism. As the Reformation gained momentum, the formerly unspeakable crime of sodomy gained a voice, as Martin Luther and others deployed accusations of sodomy to discredit the upper ranks of the Church and to create a sense of community among Protestant believers. Police records provide information about thousands of sodomites who were arrested and thousands more who were not. Michel Rey explored the sodomitical culture of the capital in five articles, based on one set of sources, published from 1982 to 1994. No one has completed his pioneering work in the archives and challenged his anachronistic conclusions about identity, community, and effeminacy. This book, the first on the subject based on extensive research in all of the relevant series of police records, explores patterns and changes in the lives of men who desired men and in the surveillance and punishment of same-sex relations across the century. Chapters 1 and 2 offer a more systematic, skeptical, and subtle analysis of complex questions about mentalities than Rey did. Chapters 3 and 4 discuss the ways in which sodomites made connections through solicitation in public spaces and networking in private places and the ways in which the police tracked them. Chapters 5 and 6 analyze the operations of agents who entrapped sodomites and the procedures of magistrates who judged them. The book examines what the extant sources do and do not tell us about the heads, hearts, and hands of men detained or mentioned by the police. To that end, it includes a generous selection of documents that allow us to hear voices from the archives, including many that require us to rethink what we thought we knew about the subculture.

This absence seems all the more glaring considering the wealth of available archival material. Sexual Hierarchies, Public Status aims to fill this gap by comprehensively examining the Aragonese Inquisition's sodomy trials. Using court records, Cristian Berco provides an analysis of male sexuality and its connection to public social structures and processes. His study illustrates how male homosexual behaviour existed within a widespread gendered system that extolled the penetrative act as the masculine pursuit of an emasculated passive partner. This sexual hierarchy based on masculinity constantly intersected in a potentially subversive manner with notions of public hierarchy and posed a threat to local sexual economies. Yet, Berco demonstrates how the views of private denouncers and magistrates in the sodomy trials produced divergent sexual economies that rendered persecution unstable and diffuse. By focusing on how hierarchies were created both within sexual relationships and in the public eye, this investigation traces the significance of homosexual desire in the context of daily social relations informed by status, ethnic, religious, and national differences.

Lawyers had been producing reports of trials and appellate proceedings in order to understand the law and practices of the Westminster courts since the Middle Ages, and printed reports had appeared in the late fifteenth century. This book considers trials in the regular English criminal courts in the eighteenth and nineteenth centuries. It also considers the contribution of criminal lawyers in developing the modern rules of evidence. The book explores the influence of scientific and pseudoscientific knowledge on Victorian insanity trials and trials for homosexual offences, respectively. The British Trials Collection contains the only readily accessible and near-verbatim accounts of civil trials from the 1760s, 1770s, and 1780s, decades crucial to understanding how the rules of evidence developed. It might be thought that Defence of the Realm Acts (DORA) or its regulations would have introduced trials in camera. The book presents a comparative critique of war crimes trials before the International Military Tribunals at Nuremberg and Tokyo and the International Tribunals for the former Yugoslavia and for Rwanda. The first spy trial by court martial after the legal change in 1915 was that of Robert Rosenthal, who was German. The book also considers the principal features of the first war crimes trial of the twenty-first century in terms of personnel and procedures, the alleged crimes, and issues of legality and legitimacy. It also speculates on the narratives or non-narratives of the trial and how these may impact on the professed aims and objectives of the litigation.
