Book excerpt: Accident law is currently under review throughout the United States, and indeed the world, as present systems prove increasingly inadequate to handle the mounting costs of automobile accidents. In this pioneering work, Guido Calabresi develops a framework for evaluating different systems of accident law. Defining the goal of accident law as the maximum reduction of accident and accident avoidance costs that can be achieved fairly, he examines ten political and economic choices implied in various approaches to reducing these costs. Calabresi then considers two fundamental problems all systems of accident law must face: who should be held responsible for accident costs, and how should they be valued? He analyzes the fault-insurance system now widely used and finds it wanting on grounds both of cost reduction objectives and fairness. In conclusion, he discusses recent proposals for reform of the law, points out questions they raise, and ends by indicating the two he thinks most likely to prevail and the fundamental conflict between them. “Calabresi’s book is most significant for its first-rate combination of modern economic analysis and legal policy. The total economic cost of motor vehicle crashes in 1994 was 150.5 billion dollars. This represents the present value of lifetime costs for 40,676 fatalities, 5.2 million nonfatal injuries, and 27 million damaged vehicles, in both police reported and unreported crashes. Property damage costs of 52.1 billion dollars accounted for the largest share of costs, while lost market productivity accounted for 42.4 billion dollars. Medical expenses totalled 17 billion dollars. Each fatality resulted in an average discounted lifetime cost of 830,000 dollars. Alcohol-involved crashes caused 45 billion dollars or 30% of all economic costs, and 78% of these costs occurred in crashes where a driver or pedestrian was legally intoxicated (>=.10% BAC). Crashes in which police indicate that at least one driver was exceeding the legal speed limit or driving too fast for conditions cost 27.7 billion dollars in 1994. Public revenues paid for 24% of medical costs, and 9% of all costs resulting from motor vehicle crashes. These crashes cost taxpayers 13.8 billion dollars in 1994, the equivalent of 144 dollars in added taxes for each household in the United States.

The National Highway Traffic Safety Administration (NHTSA) estimates that over 16,000 lives could be saved annually if all front seat occupants wore safety belts. To assist ongoing federal and state deliberations on safety belt safety, the Chairman, Subcommittee on Water Resources, Transportation and Infrastructure, Senate Committee on Environment and Public Works, and the Ranking Minority Member, Senate Committee on Environment and Public Works, asked GAO to evaluate and summarize existing studies on safety belts. This report focuses on the (l) effectiveness of safety belts in reducing deaths and serious injuries, (2) impact of state safety belt use laws on fatality and serious injury rates, and (3) costs that society incurs when unbelted motor vehicle occupants are involved in accidents.
